Employment Contracts Below RM3,000 Exempted from Stamping

LHDN has clarified the following (via LHDN Circular dated 7/8/2026)

1. Employment contracts with monthly remuneration of RM3,000 or below are exempt from stamp duty and do not need to be stamped or endorsed.

2. For employees earning more than RM3,000 per month, only the principal employment contract containing the main terms and conditions must be stamped and endorsed. Any ancillary instruments relating to the same employment do not require stamping or endorsement.

3. Instruments falling under the General Exemption category under Section 35 of the Stamp Act 1949 must still be endorsed to confirm eligibility for the exemption.

📌3 months to lodge outstanding Annual Returns and Beneficial Ownership information
📌6 months to lodge outstanding Financial Statements
📌3 months to submit striking off applications

Benefits for participating companies:
✅Exemption from compound offers and prosecution for 6 months from the date the undertaking is given.

✅Companies that complete the recovery actions will receive higher compound reductions, ranging from 90% to 98.75%, equivalent to RM900 to RM39,500, depending on the offence section.
