Kos Tukar Nama Pada Geran Rumah

Terdapat pelbagai sebab seseorang individu ingin menukar nama pada geran rumah. Antaranya ialah penjualan aset hartanah, faraid, penceraian dan sebagainya.
Kali ini admin akan mengupas tentang tiga skop yang berbeza mengenai tukar nama pada geran rumah yakni syarat tukar nama pada geran rumah, proses penukaran nama pada geran rumah dan akhir sekali ialah kos.

1. Syarat Tukar Nama Pada Geran Rumah

- Orang yang bertanggungjawab menjadi Pemberi Pindah Milik (PPM) ialah individu yang mendaftarkan namanya pada rumah tersebut.
- Mempunyai surat perjanjian yang mengesahkan rumah tersebut akan dijual daripada individu A kepada individu B.
- Rumah ini juga wajib bebas daripada sebarang sekatan atau kaveat. Rumah tersebut mestilah rumah yang bebas.
- Rumah tersebut tidak boleh digadaikan kepada mana-mana bank dalam sebarang urusan perbankan dan juga urusan perundangan.

2. Proses Tukar Nama Pada Geran Rumah

2.a Penyaksian Geran Rumah

Buat pengetahuan anda, sebenarnya terdapat tiga proses dalam menukar nama pada geran rumah dan setiap proses harus dilakukan mengikut turutan dan anda diwajibkan menyediakan dokumen yang lengkap.
Dalam proses ini, anda hanya perlu mengisi borang 14A Kanun Tanah Negara dan perlu diisi oleh pemberi yang tercatat nama di geran, penama pembeli dan juga penerima penjual.

Selepas itu, anda perlu melakukannya samada di hadapan peguam mahupun pegawai pentadbir.

Apa yang paling penting ialah mereka – mereka yang disebutkan di atas yakni pembeli, penjual dan pemberi harus hadhir tatkala penyaksian borang ini dilaksanakan.
Antara dokumen yang perlu anda sediakan semasa proses ini ialah :-

- Kad Pengenalan kedua belah pihak.
- Geran Hakmilik ASAL.
- Borang 14A (Wajib diisi dengan PEN DAKWAT HITAM SAHAJA). Tidak boleh dipadamkan dengan liquid.
- Sijil Kelahiran Asal jika melibatkan hartanah Rezab Melayu.
- Surat Pemegang Amanah (jika berkaitan).
- Surat Kebenaran Pindah Milik /Gadaian jika geran tercatat adanya Sekatan-Sekatan Kepentingan atau Kaveat.

2.b Taksiran Duti Setem

Dalam proses ini, penama seperti yang disebutkan pada poin 2.a harus menandatangani Borang Permohonan Taksiran Pindah Milik Hartanah atau lebih dikenali sebagai Borang PDS 15.

Untuk borang ini, penama seperti yang dinyatakan hanya perlu mengantar wakil ke LHDN sahaja. Antara dokumen yang penting dalam proses ini ialah :-

- Borang PDS 15 yang diisi dan ditandatangani
- Salinan Borang 14A.
- Salinan Geran.
- Salinan Kad Pengenalan semua pihak.

Kiraan jumlah Duti Setem LHDN yang dikenakan untuk pemindahan Hakmilik Hartanah adalah seperti berikut :-

i) RM 100,000 pertama 1%
ii) RM 100,001 hingga 500,000 2%
iii) RM 500,001 dan ke atas 3%

2.c Pendaftaran Geran Hartanah

Untuk proses ini, anda perlu ke Pejabat Tanah Daerah mahupun Pejabat Pendaftar yang terdekat supaya surat penguatkuasaan hakmilik dikeluarkan. Dan ini semestinya melibatkan pelbagai dokumen yang perlu diserahkan oleh pembeli.
Antara dokumen yang anda wajib bawa untuk penyerahan ialah :-

- Borang 14A asal.
- Hakmilik / Geran asal.
- Sijil Setem LHDN.
- Notis Taksiran LHDN asal.
- Salinan Kad Pengenalan depan dan belakang pembeli / penerima.
- Salinan Kad Pengenalan depan dan belakang penjual / pemberi.
- Salinan resit / bil Cukai Tanah Tahun Semasa.
- Salinan resit / bil Cukai Taksiran (Pintu) Tahun Semasa atau surat/resit pengesahan Majlis Bandaran.

3. Kos Tukar Nama Pada Geran Rumah

Sebelum anda mengira kosnya, anda perlu tahu caj yang akan dikenakan pada pembeli rumah itu iaitu :-

Duti Setem Perjanjian Jual Beli
– 1% ke atas RM100,000 pertama
– 0.5% untuk RM4,900,000 seterusnya

Duti Setem Perjanjian Pembiayaan
– 0.5% daripada jumlah pinjaman atau RM5 bagi setiap RM1,000

Duti Setem Pindah Hakmilik
– 1% ke atas RM100,000 pertama
– 2% untuk RM400,000 seterusnya
*untuk rumah sudah siap sahaja

- RM150,000 pertama – 1%
- RM150,001 hingga RM850,000 – 0.7%
- RM850,001 hingga RM2,000,000 – 0.6%
- Atas RM 2,000,000 – 0.5%
