🇲🇾 Can a company dismiss an employee just because they are sick? 🤒

⚠️In reality, the law does not only look at whether the employee is sick

The key question is: Can the employee still perform their job duties❓

Companies usually assess:
✔ Severity of the illness
✔ Impact on job responsibilities
✔ Recovery period & risk of relapse
✔ Whether reassignment is possible
✔ Professional medical opinion

Many employees end up at a disadvantage because they do not know whether the company followed the proper process.

⚠️ Being sick does NOT automatically justify dismissal.

Typically, only misconduct or poor performance are valid reasons for termination. Employers must conduct a domestic inquiry and give employees a chance to improve.

🚨 If proper procedure is not followed, it may be considered unfair dismissal.

Real case: A telecom company was ordered to pay RM1,036,640 due to an improper dismissal process.
