🚨 Attention IP Managers & Tech Startups in Malaysia: MyIPO’s Proposed Patent Fee Hike 🚨The Intellectual Property Corporation of Malaysia (MyIPO) has published a crucial public consultation paper proposing significant revisions to statutory patent fees and new targeted incentives. If you manage an intellectual property portfolio, this will directly impact your R&D budgets and prosecution strategies. I’ve just published a new breakdown on what these changes mean for the industry—and where we need to push back.Here are my 3 primary takeaways from the proposal:The Missing Digital Piece: MyIPO is citing ICT modernization as a key driver for the fee hike. However, Malaysia still does not provide open, full online patent specifications for public inspection. If fees are increasing to fund digital infrastructure, MyIPO must align with international practices (like the EPO and USPTO) by opening up full patent specifications online to promote local commercialization and reduce redundant R&D. The 3-Year Incentive Bottleneck: MyIPO proposes a 20% fee reduction for SMEs, startups, and research institutions, but limits this incentive to only three years. The reality? The patent lifecycle from filing to commercialization often takes much longer. Cutting off this financial support at the 3-year mark risks abandoning resource-constrained innovators right when they need to defend and maintain their patents the most. Rebalancing Examination Fees: While general administrative fee hikes are understandable, the proposed RM550 increase for standard Substantive Examination (Form 5) creates a steep barrier. Instead of hiking Form 5 to RM1,650, MyIPO should equalize the fee structure: keep Form 5 at a lower rate, and price Form 5A (Modified Substantive Examination) at RM1,100. ​The USPTO has released new guidance for AI-assisted inventions, settling a major question for innovators.
​The verdict: AI is a tool, not a creator.
​Generative AI and other computational models are now formally considered analogous to laboratory equipment or research databases. They can assist in generating ideas and designs, but the legal credit for conception—the core of inventorship—must rest with a natural person.
​If a human makes a significant contribution to the invention, their patent application is evaluated under the same legal standard as any other.
