员工动不动就说“我要去JTK告你!”

很多老板一听到这样,第一反应就是:完了,是不是我错了?
其实,不一定。

📌 什么是 JTK - Jabatan Tenaga Kerja Malaysia ?

JTK是马来西亚劳工局, 员工可以在权益受影响时去投诉。

📌 常见投诉原因有几点:
❌ 薪水迟发 / 没给/发错/算错
❌ OT 没按劳动法给/算错
❌ 没有Payslip
❌ 年假 / 公假算错
❌ 不合理扣薪
❌ 无理由辞退/没有依照劳工法进行辞退

💡 但是, 员工投诉 ≠ 公司一定错

JTK是看证据的!

👉 有文件,有记录,你就有优势
👉 流程和文件没有其全,就算你有道理,也很危险

🚨 很多公司输case的原因, 不是因为真的做错;

而是因为:
❌ 没有contract
❌ 没有HR制度
❌ 没有记录
❌ 全部靠“讲”

This sentence alone is enough to make many employers panic.
But here’s the truth:

A complaint to JTK does NOT mean employers are wrong!
Most JTK cases happen because of:
❌ No proper contract
❌ Payroll mistakes
❌ Miscommunication with employees
❌ No clear HR policy
❌ Termination without proper procedure/documentation

Not because the employer did something “bad”!

📌 JTK also doesn’t simply side with employees. They look at evidence.
So the real question is:
👉 Do you have proper documentation?

Because in reality:
Documents = Evidences

No document = High risk to lose case

Should we hire an internal HR, or outsource HR expertise?

Both options have their strengths, but the right choice depends on your company’s stage, structure, and needs.

An internal HR usually handles everything from recruitment, payroll, staff issues, and administration. However, when one person manages all HR functions, their exposure and capacity can sometimes be limited.

Friendly Reminder to All Employers: Don’t Forget These LHDN & Statutory Actions!

Running a business is already challenging but don’t overlook your employer compliance responsibilities.

Here’s a quick reminder of important submissions and payments every employer in Malaysia should take note of:

📌 Stamp Duty (Employment Contract e-Stamping)
Employment contracts should be stamped within 30 days via LHDN.

📌 Form CP22
Submit when hiring a new employee (within 30 days).

📌 Form CP22A
Submit when a local employee resigns (at least 30 days before last working day).

📌 Form CP21
Required when a foreign employee resigns or leaves Malaysia for more than 3 months. Employer must withhold payments until tax clearance.

📌 MTD / PCB (Monthly Tax Deduction)
Deduct and pay employee income tax to LHDN before the 15th of the following month.

📌 EPF (KWSP)
Monthly employer & employee contributions — due before the 15th.

📌 SOCSO (PERKESO)
Mandatory social security contribution.

📌 EIS
Employment Insurance contribution (under PERKESO).

📌 HRD Levy
Applicable employers must contribute 1% of wages to HRD Corp.

经营生意本来就不容易,但千万不要忽略作为雇主的合规责任。

以下是马来西亚所有雇主必须留意的重要申报与缴付事项:

📌 印花税(雇佣合约电子盖章)
雇佣合约必须在签署后 30 天内通过 LHDN 进行电子盖章。

📌 Form CP22
聘请新员工时需在 30 天内提交。

📌 Form CP22A
本地员工辞职时需提交(至少在最后工作日前 30 天)。

📌 Form CP21
