Considering the term is so widely used these days, it's hard to imagine how many never knew it was an actual trademarked term and how they were able to obtain the trademark in the first place.

In fairness, the term was certainly more niche in the 80s than it is today, and in trademark law, the more unusual or niche a term is, the more likely it is to qualify for protection.

In this day and age, though, superheroes are the hot commodity and the term has become much more common in our modern vernacular than ever thanks to DC and Marvel's film and TV franchises.

Unless someone can prove that the term 'superhero' has lost its association with a specific brand, then the trademark is likely to stay for the foreseeable.
