As Nigeria celebrates its Independence Day, let's take a moment to honor some incredible Nigerian inventors who have made significant contributions to science, technology, and various other fields.

Their innovations have not only made Nigeria proud but have also impacted the world positively.

1. Philip Emeagwali - Known as the "Bill Gates of Africa," Emeagwali is a renowned computer scientist and inventor. He won the 1989 Gordon Bell Prize for his work on high-performance computing and is often credited with pioneering the application of supercomputers for oil field calculations.

2. Seyi Oyesola - A medical doctor and inventor, Oyesola co-developed the "Hospital in a Box" or CompactOR, a portable hospital system that provides essential medical services in remote areas. This invention has saved countless lives, especially in disaster zones.

3. You Oviemo -A Medical doctor who invented the Emergency Autotransfusion device called the Eatset which is used to recover blood from a patient's internal bleeding organs and reinfused back into the Patient

4. Kemisola Bolarinwa- invented a smart bra that can diagnose early stage breast cancer and

5. Mohammed Bag Abbah who invented the Pot- in Pot Refrigerator, a refrigerating device that does not require electricity to operate which makes it very useful in rural areas without electricity.

These inventors, among many others, exemplify the spirit of innovation and resilience that defines Nigeria.

As we celebrate our independence, let's also celebrate the achievements of these brilliant minds who continue to put Nigeria on the global map.

"Can I lose the rights to my registered trademark?"
.....YES

One of the reasons why you could lose the rights to your trademark despite being issued a valid trademark certificate is the failure to apply for trademark renewal as at when due. This often leads to a cancellation of the trademark from the register.

In Nigeria, a trademark is due for renewal 7 years after the registration for the first renewal. You will be issued a Trademark Renewal Certificate after each renewal.

Subsequent renewals are due after every 14 years till in perpetuity as long as the trademark proprietor is still using the trademark in business.

This is why we have trademarks existing as far back as 1859 .
Some of the oldest trademarks that are still in existence are the Czech beer brand PILSNER registered in 1859, Bass's red triangle (1876), and the Samson fighting a lion mark (1884).

These marks are still valid today because the trademark owners or their descendants and successors are diligent in filing their renewals as at when due.

Do not assume that having a trademark Certificate is the end of the matter, you owe a duty of care to your brand to ensure that you renew your trademarks as at when due.

Can Brain Jotter make use of Mr Mike Ejeagha's Gwo Gwo Gwo Ngwo Song in his Skit without the Owner's Consent?, An IP Perspective

First of all it must be pointed out that Copyright subsists automatically in such creative work and it's immaterial whether Mr.Mike took steps to register the work officially or not.

Mr Mike owns the Copyright in that song for all the time he will live on earth and even 70 years after his demise and anyone who needs to make use of the work must obtain his consent first else it will amount to an infringement.

There are however instances where such work can be used without the consent of the creator and it won't be considered an infringement.

One of such situation is under the Fair Use criteria.

To decide if Brian Jotter's usage of the work constitutes fair use, one must consider several factors such as

1. the amount of the work used, if he used a substantial part of the song then it's not fair use

2. the purpose of usage whether for commercial purposes or not,

3. whether the use of the work is transformative i.e did he add any original idea to the work or he just replicated the work entirely without adding his own idea

4. What is the effect of Brian Jotter's usage of the work on the market value of Mr.Mike's song? Will the usage of the song in the skit reduce the monetary value or cause a loss of revenue to Mr.Mike?

It is only when the above points are determined that it can be concluded on whether the usage constitutes fair use or whether it's an infringement.🤷

Earlier in the year, I went to the market to get an Ankara wrapper for a love one, got to this shop and couldn't make up my mind on the particular design to choose from, I decided to do a video call with my sisters so they could help me choose.

The seller opposed me vehemently and insisted that he doesn't allow anyone take pictures or videos of his wares,

When I asked why he said even his suppliers do not allow any one to snap the designs as they do not want them to be replicated.

I smiled and said ok.

Truth is preventing people from taking pictures or videos of your designs cannot stop your competitors from replicating same.

The best step is by getting the appropriate legal protection for those designs by way of an industrial designs registration.

That way you are sure of getting a legal remedy should anyone replicate them

DEFENSIVE TRADEMARKING

Did you know that, there are five countries that offer defensive trademark registrations in Africa and they are Kenya, Nigeria, Uganda, Zambia and Zimbabwe ?

Defensive trademark registrations are most allowed for well known and popular brands who intend to use it as an effective protection against copy cats and or otherwise Infringement.

It is also a proactive measure for proprietors who intend to evolve into other sectors of activity using the same trademark at a later stage.

Under the 'nice classification ', there are 45 classes of trademark registration so your ability to register your mark in all these classes is the exact definition of a defensive trademark registration. This is to restrict others from holding the same brand name as trademark though in a different class.

Come to think about it, who told you your brand is not popular? the popularity of a brand depends on the acceptability and how people identify with the brand whether in good or service delivered within the jurisdiction of brand usage.

Do not underrate your brand , it can be argued that they are popular and well known in your location, take that step to protect your mark from syndicates and squatters

While you review your legal compliance checklist, have you also check your intellectual property or tick right your trademark ?

The checklist contains a list of items that helps your organization to track necessary documentations that must be verified to ensure the organisation is in compliance with applicable laws and regulations.

As you try to stay compliant to the rules and regulations of the state to avoid restrictions, remember to also stay protected statutorily to avoid brand theft or copycats. Register your business names, logos, colours and catchphrases now!

Bear in mind, If you do not register your intellectual property right, you stand the risk of it being registered by another person who may rightfully claim damages for unauthorized use by you and as well as prevent you from using the same even though you are the first owner but because you failed to register the same.

Nigeria is a first-to-file jurisdiction therefore, for your intellectual property "trademark, patent, industrial design and copyrights" to enjoy statutory protection in Nigeria, it must be registered in Nigeria otherwise you won't be able to enforce your intellectual property rights let alone claiming damages should it be infringed upon.
