PRIMARY ELECTIONS

Candidates that lost out of primary elections in their party can now safely defect to other parties to contest the same elections.

This is in line with the Judgement of the Federal high court nullifying the time table of the INEC for 2026 elections.

As for the voters registrar, the implication is that it will be resubmitted or updated as the already submitted version is of no consequence in law for the main time.

AFTER PARTY PRIMARIES

Candidates who feel aggrieved by primary elections already conducted should approach the federal high court, as their cause of action has already crystallised and is now ripe.

DEFAMATION CAN LEAD TO CRIMINAL PROSECUTION

Undoubtedly, defamation, whether in the form of libel or slander, is a civil matter under our civil law system. However, certain defamatory publications can lead to criminal prosecution if they contain elements of cyberbullying or crimes under the Cybercrime Act. Consequently, the victim may choose to pursue either a civil or criminal case, or both. Therefore, every publisher must exercise caution when selecting their words.

PROSECUTION LAWYERS NOT PERSECUTORS.

One of the primary responsibilities of a legal practitioner working at the department of public prosecutions is to ensure that prosecutions do not amount to persecutions by filing frivolous and malicious charges. I have reviewed the charges against Justice Crack as filed by the department of State security services. Regrettably, the document falls short of what constitutes a legitimate charge. Beyond being a persecution, the lawyers who prepared the charges are deserving of disciplinary action for failing in their duties. Unfortunately, this act has become a recurring pattern with agencies like the Nigerian police and others. A situation where lawyers are used to aid illegality that truncates fundamental human rights is highly disturbing and unfortunate.

Surrogacy and the Law in Nigeria: A Professional Perspective.

Surrogacy is a legally recognized assisted reproductive arrangement wherein a surrogate mother carries and delivers a child on behalf of intended parents, thereby providing a solution to infertility, medical complications, and other childbearing-related challenges. Nigerian law permits surrogacy, and it is not considered a crime. Nonetheless, the methodology employed by parties involved in achieving surrogacy may be deemed criminal if standard protocols and procedures are not adhered to, potentially resulting in multiple legal infractions. Therefore, it is advisable for prospective parents or individuals contemplating surrogacy to seek guidance from an experienced attorney to ensure compliance with relevant laws and regulations.

Legal implications for careless statements

Certain comments you make on Facebook or other social media platforms can lead to a civil defamation suit or a criminal charge of cybercrime, or both.
Hence, it is essential to exercise caution with your comments on a daily basis.

Tenancy issues

Prior to making rental payments for a property, it is essential to verify that all necessary repairs have been completed. Otherwise, if payment is made and subsequent complaints arise regarding the habitability of the premises, such issues typically lead to disputes involving various legal complexities.

Land purchase

You don't involve a lawyer only after you have paid for a landed property. Instead, you are meant to involve a lawyer before purchasing the said property.

It will save you a lot of legal troubles.

The law and surrogacy

In Nigeria, surrogacy is not a crime provided parties follow the due process legally permitted by law. In other words, it is the procedure adopted by the persons involved that will determine whether the act itself is a crime .
Persons who intend to have children through surrogate means, must, in addition to using a qualified and licenced facility, engage the services of a seasoned lawyer to guide them through the legal pitfalls.
