In fact, the Environmental Impact Assessment Act (EIA) No. 86 of 1996 makes it mandatory for proponents of all new major developmental activities to carry out impact assessment of their planned projects, so as to achieve balanced decision-making of the environmental effects in total public interest. Contractually the Firm shall facilitate enlightenment on the actions involved in project(s) construction/installation and production activities. It is instructive to state that Nigeria has ratified relevant treaties and conventions for the operation of nuclear power programme and that technical framework is being developed by the Nigeria Atomic Energy Commission (NAEC) for the generation of electricity through nuclear power plants. Ratification means approval for the IAEA’s Nuclear Safeguards Inspectors to access the installation within the country’s jurisdiction to determine its safe applications. The International Basic Safety Standards (BSS) for Protection against Ionizing Radiation and the safety Radiation Sources define the national infrastructural requirements for radiation protection and safety. Thus, as Nigeria awaits the “Nuclear Safety Bill” by the National Assembly, the Nigerian Nuclear Regulatory Authority (set up by the Nuclear Safety and Radiation Protection Act No 19 of 1995) has the responsibility for nuclear safety and radiological protection. The ACT makes it mandatory for the NNA to provide training, information and guidance on nuclear safety and radiation protection as well. Of note therefore, is that Nigeria had since 2004 operated a Nuclear Research Reactor (the NRR-1) at the Centre for Energy Research and Training (CERT) Zaria. The NNRA statutorily functions by ensuring protection of life, health, property and the environment from the harmful effects of ionizing radiation, even with its acquisition of a Mobile Vehicle Based Emergency Radiation System (MOVERS) for timely emergency responses.
