Zan takaitacciyar fassarar rubutun da na yi a kan zaben Kano da turanci zuwa Hausa.
A cikin rubutun na yi tambaya ne a kan tabbacin cewa kuri'ar da bata stamfi, da sa hannu, da kwanan wata.
Na fara da nazari a kan dalilan da suke sa a soke zabe (kamar yadda dokar zabe [Electoral Act, 2022] ta tanadar). wadannan dalilai, kamar yadda s**a zo a sashe na 134(1) sun hada da
1. Rashin cancantar dan takara da tsayawa takara
2. Rashin bin dokar zabe da magudi a yayin gudanar da zabe
3. Rashin samun mafi rinjayen sahihan kuri'u
A shari'ar da ke tsakanin APC da NNPP ana magana ne a kan kuri'un da ba a yi wa stamfi ko sa hannu ko kwanan wata ba.
Sashi na 63(1) ya kawo cewa duk ballot paper din da bata da "official mark" ba zaa lissafa ta ba. Amma kuma a gaba sashi na 63(2) ya kawo cewa idan returning officer ya hakikance cewa wannan ballot paper din mara official mark ta zo ne daga littafin ballot papers, to ya zama wajibi shi returning officer din ya lissafa wannan ballot papers din duk da basu da official mark.
Wadannan dokoki karara suke nuna cewa rashin official mark a jikin ballot paper (a karan kansa) baya lalata ballot paper din har sai an tabbatar da cewa ballot paper din ba daga cikin littafin ballot papers din INEC ta fito ba.

Hakan yana nufin cewa in dai an bi electoral guideline to dukkanin kuri'un da aka zuba invalid ne (saboda guideline din bai ce a saka sunan presiding officer ba). Abin tambaya a nan shine wa ke da hakkin tantance hakan? APC ne ya kamata su tabbatarwa da kotu cewa kuri'un ba na makafi bane ko kuma NNPP ne suke da haqqin tabbatarwa da kotu cewa kuri'un masu laurar gani ne? Ina kyautata tsammanin cewa APC ne suke da haqqin tabbatarwa da kotu cewa ba kuri'un masu larurar gani bane. Wannan maganar ma ban ga an tattauna ta ba.
Abu na gaba shine shin rashin bin guideline na INEC (misali saka stamfi, sa hannu, da kwanan wata a bayan ballot paper, wanda babu wannan maganar a Electoral Act) yana iya sanyawa a soke zabe ko da ba saba kowace doka ta Electoral Act ba. Amsar wannan tambaya, idan muka yi la'akari da hukuncin da Justice Tsammani ya yi a case din Peter Obi, ita ce Aa. Justice tsammani ya yanke hukuncin cewa bai zama wajibi ga INEC ta tura sakamakon zabe zuwa IReV portal ba duk da cewa INEC guideline ya ce lallai a tura sakamakon zabe ta BVAS zuwa ga IReV portal.
Wannan kuma ya kara yin daidai da sashi na 134(2) da ya ce idan Malamin zabe ya aikata wani abu ko ya ki aikata wani abu sannan abinda ya yi din karya iyaka INEC guideline, amma bai karya electoral act ba, toh wannan abinda malamin zabe ya aikata ba zai zama hujjar shigar da kara ba.
Duk wadannan batutuwa da na taso da su batutuwa ne da watakila su iya taimakonmu a appeal idan har muna da damar shigar wadannan korafe-korafen cikin appeal din mu. Na san akwai abubuwa da yawa da s**a fi wadannan batutuwa da na kawo. Amma wadannan hujjoji da nake kyautata zaton zasu yi wa tuhumar APC kisan falan daya. Zai yi kyau lauyoyin NNPP su dubi wadannan batutuwa su kara su a cikin appeal.
