DIFFERENCE BETWEEN MURDER AND MANSLAUGHTER.....

Two people died… but the law did NOT treat both cases the same...

Not every killing is called murder.

Sometimes, the law calls it manslaughter......

But what is the difference?

MURDER (🦴🔪🛠️⛏️🗡️)....

Murder is when:

A person intentionally kills another person
Or knows that what they are doing will likely cause death

Example:

Chinedu plans to kill his friend.
He brings out a knife and stabs him.

That is MURDER.....

Why?

Because there was intention to kill

MANSLAUGHTER

Manslaughter is when:

A person kills another person without planning to kill

It can happen:

- By mistake
- In anger (heat of the moment)
- Through carelessness

Example:

During a fight, Emeka pushes someone in anger.
The person falls, hits his head, and dies.

That is MANSLAUGHTER.

Why?

There was no intention to kill

THE MAIN DIFFERENCE

Murder = Intentional killing
Manslaughter = Unintentional killing

Both are serious offences...

Murder usually carries heavier punishment (even life imprisonment or death penalty in Nigeria)
Manslaughter has lighter punishment depending on the situation

Think about this...
If you had already poisoned your friend’s food but she hadn’t eaten it yet, and during a heated argument you slapped her and she fell and died…

Should that be murder or manslaughter?

FREQUENTLY ASKED QUESTIONS IN LAW AND THEIR ANSWERS

1. CAN THE POLICE ARREST SOMEONE IN PLACE OF A SUSPECT (ARREST IN LIEU)?

No. The police cannot arrest someone in place of a suspect.
"Arrest in lieu" means arresting another person such as a spouse, relative, or friend instead of the actual suspect, in order to lure the suspect to surrender.
This practice is illegal and unconstitutional, and it is expressly prohibited under Section 7 of the Administration of Criminal Justice Act (ACJA) 2015.

2. CAN SOMEONE BE PUNISHED FOR BUYING OR POSSESSING STOLEN PROPERTY?

Yes. Anyone who knowingly buys, receives, or keeps stolen property commits an offence.
Even if they claim ignorance, they can still be held liable if it is shown that a reasonable person in their position ought to have known the goods were stolen.
Section 427 of the Criminal Code

3. WHAT IS THE "LAST SEEN RULE" IN CRIMINAL LAW?

The "last seen rule" means that when a person was last seen alive with another and is later found dead, the court may presume that the person last seen with the deceased is responsible for the death unless they provide a satisfactory explanation of what happened or how they parted ways before the death occurred.

4. IS A CONFESSIONAL STATEMENT MADE UNDER COERCION ADMISSIBLE IN COURT?

No. A confessional statement obtained through threat, torture, inducement, or coercion is inadmissible in evidence.
For a confession to be accepted by the court, it must be voluntary, true, and made without pressure.
Thus, where the voluntariness of a confessional statement is in doubt, the court may conduct a trial-within-trial to determine its admissibility.

What is the difference between a Magistrate and a Judge?

Many people use these terms interchangeably, but in Nigerian law, they are not the same.

📌 1. Appointment

A Magistrate is appointed by the State Judicial Service Commission.

A Judge (of the High Court and above) is appointed by the National Judicial Council and confirmed by the appropriate authority.

📌 2. Level of Court

Magistrates preside over Magistrate Courts (lower courts).
Judges preside over High Courts, Court of Appeal, and Supreme Court (superior courts of record).

📌 3. Powers & Jurisdiction

Magistrates handle less serious criminal cases and civil matters with limited financial jurisdiction.
Judges handle more serious criminal cases (including capital offences) and high-value civil matters.

📌 4. Qualification

Magistrates are experienced lawyers, but requirements vary by state.
Judges must meet stricter constitutional requirements (e.g., minimum years at the Bar).

📌 5. Mode of Address

Magistrate → “Your Worship”
Judge → “My Lord” / “Your Lordship”

⚖️ In simple terms:

A Magistrate handles less complex matters at a lower level, while a Judge handles more serious and complex cases at higher courts.

Both are vital—one is not superior in importance, but they operate at different levels of the justice system.
