DID YOU KNOW AN EXPIRED TENANCY DOES NOT REQUIRE THE ISSUANCE OF QUIT NOTICE?

Undoubtedly, this is a regular overlay from lawyers to issue quit notice to tenants upon the expiration of their tenancy. However, it is important to note that once a tenancy has been determined by the expiration of time, it is redundant to issue a quit notice to the tenant.

It is also noteworthy that a tenancy determined by the expiration of time depicts that the period for which rent was paid had expired. Invariably, the situation that requires the service of proper quit notice is where the tenancy still subsists, and it doesn’t interest the landlord to renew such tenancy.

Also, where a tenant is in arrears of rent for a specific period of time provided by law, such tenancy is altered to a tenancy at will, and it is consequently needless to serve a quit notice as the only required service is that of a 7-days notice of owners to recover possession.

Let's talk about Title to Land.

We have the
Legal title : Registered
Equitable title : Unregistered title.

When we say a property has an equitable title , it means that the title of the property does not comply to statutory requirement , it means that the title have not fulfilled the provision of govt. Proper documentation have not been carried out on that title.

While property with Legal title are registered property , which has fulfilled all statutory requirement of ownership e.g C of O. Governors Conscent.

Some transaction in Land can be primary transaction , meaning that the property has no root to title. That also mean that there is no history of the property with the govt e.g When one buys lands from a village or community, most of such transaction are primary transaction, and in most cases the buyer is issued receipt or a deed of assignment is prepare between both parties.

In such case, it is the responsibility of the buyer to carry out proper requirement to register the title with the govt in his name for proper and secured ownership.

Note: Both Legal and equitable title are transferable. But it is safer to invest in property that has a legal title than that with an equitable title.
Also properties wirh Legal title tend to command more value than that with equitable title .
