𝟮 𝗧𝗶𝗲𝗿 𝗦𝘆𝘀𝘁𝗲𝗺 𝗳𝗼𝗿 𝗚𝗿𝗲𝗲𝗻 𝗟𝗶𝘀𝘁

👉Tier 1- Straight to Residence
👉 Tier 2- Work to Residence

👉 People working or having a job offer in occupations in Tier 1 can apply for residence straightaway from 05 September 2022.

👉 People working in Tier 2 occupations on the Green list can apply for residence after working for 24 months. Time can be counted from 29 September 2021, (Must hold an Accredited Employer Work Visa from 04 July 2022 in order to apply)

𝗛𝗶𝗴𝗵𝗹𝘆 𝗣𝗮𝗶𝗱 𝗥𝗼𝗹𝗲𝘀

👉 People working in highly paid occupations($55.52 per hour currently from 04 July 2022 and $54.00 between 29 September 2021 and 03 July 2022) can apply for residence after 24 months. Time can be counted from 29 September 2021, (Must hold an Accredited Employer Work Visa from 04 July 2022 in order to apply.

𝗦𝘁𝗮𝗻𝗱𝗮𝗿𝗱 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁𝘀 𝗳𝗼𝗿 𝗮𝗹𝗹 𝗰𝗮𝘁𝗲𝗴𝗼𝗿𝗶𝗲𝘀

👉 be 55 years old or younger

👉 be able to meet the Skilled Migrant Category English language requirements,

👉 be able to meet standard health and character requirements for residence, and
👉 have or have been offered a job with an accredited employer, whose accreditation has not been suspended.

👉 Acceptable Employment or Offer must be for minimum of 30 hours per week, contract for service for 6 months is also accepted if it is current. Fixed-term roles are also accepted as long as for a minimum of 12 months.

👉 The 24 months of work in New Zealand does not have to be completed consecutively and can be a total of different periods, for example, two 12-month periods with a gap of six months between. Additionally, it can be made up of different types of work in New Zealand, for example, 6 months in a Tier 2 Green List role and 18 months in a role paid twice the median wage.

Having worked in both Employment and Immigration Law, we can confidently say after reading the policy guidelines for Accredited Employer Work Visa that this category will turn out to be a minefield for the employers. This will add a huge financial and administrative burden on the NZ businesses, it will push them to the limit of becoming reluctant to offer jobs and visa support to Non-New Zealanders, which is bad news for the economy, especially in these times.

The following is confirmed by INZ in the latest visapak:
👉A partner, spouse, or dependent child who has applied in the past for a visa based on their relationship to the principal applicant for a residence class visa, but who does not currently hold a visa based on that relationship and does not have an application based on that relationship being processed, does not have to be included in the residence application.
👉 Where a partner or dependent child is required to be included in a residence application, they cannot be removed, unless there is a change of circumstances that results in them ceasing to be the spouse/partner or dependent child of the principal applicant.
👉 This applies even if, after the residence application has been lodged, they withdraw a temporary entry visa application which has been made based on their relationship to the principal applicant, or they no longer hold a visa based on that relationship.
