Contractor or employee? Get it wrong and the cost lands on you, not them. Six months into the Gateway Test, most businesses still can’t answer this confidently.

The Gateway Test is the tool. It sets five criteria a person must meet to count as a contractor under the Employment Relations Amendment Act 2026. Businesses have had to apply it since the Act came into force.

A signed agreement isn’t enough on its own. If your day-to-day practice contradicts what it says, the agreement doesn’t win. Before you sign any more contractor agreements, check your practice matches your paperwork.

Remember: if the working relationship started before 21 February 2026, or doesn’t meet all the Gateway Test criteria, you must use the Common law test instead.

Our Tauranga team attended an NZISM event last Thursday, and it was a good one to be part of, the calibre of speakers was exceptional.

Montana sits on the NZISM BOP committee. Carolyn, our eLearning account manager, took the stage to speak and also ran an exhibitor table, giving attendees a hands on look at our eLearning services. Elise, our H&S Manager, and Sam, one of our grads, rounded out the crew, soaking up the day and connecting with the wider H&S community.

Always good to spend time with the people doing this work day to day around the motu.

This week our eLearning videographer, Jarod, has been down in Fiordland filming a safety module for Milford Sound Tourism.

Of course, the local kea made sure to welcome him. Staying out at K***s Flat with the rain coming and going and the mountains disappearing into fog. It was great to catch up with Ginny on site, its always a highlight seeing her.

This is the part of the job that doesn't always make it into the final module, capturing the place as it actually is, weather and all, before the real work of turning it into training people will use.
