We have been fielding a number of questions from farmers and landowners about Environment Canterbury’s proposed Plan Change 8 and what it could mean in practice.

One of the key issues it seeks to address is how water can be used under an existing consent. For example, a consent may allow water to be used for irrigation, but not for other farm-related purposes such as dairy shed water, stock water or washing solar panels.

Following recent court findings, there has been no clear pathway to change the purpose of use without applying for a new consent, even when no additional water is being taken. This has been particularly difficult in fully or over-allocated catchments.

Plan Change 8 proposes a pathway for some existing water permits to be replaced with a new consent covering a different use. It also includes proposed changes relating to groundwater interception for community infrastructure and making constructed wetlands easier to establish.

The plan change is deliberately targeted and is not a full review of the Canterbury Land and Water Regional Plan.

Submissions can support the proposed changes, oppose them, or support them while suggesting amendments. Whatever your view, making a submission is an opportunity to explain how the proposed rules could work in practice and what they may mean for your property or farming operation.
