The National Privacy Commission (NPC) provides guidance on the legal standing of juridical entities in filing complaints under the 2021 NPC Rules of Procedure and its subsequent amendment. Juridical entities may file complaints on behalf of one or more data subjects, subject to specific authorization requirements.

To ensure proper representation, the following conditions must be met:

1. The individual filing the complaint is equipped with a Special Power of Attorney from the data subject(s); and

2. That same individual is authorized via a Board Resolution and Secretary’s Certificate to act on behalf of the juridical entity.

These requirements ensure that complaints filed through juridical entities are made with proper authority, and that both the interests of data subjects and the integrity of the complaint process are safeguarded.
