THE POSITIVE AND NEGATIVE IMPLICATIONS OF DIGITAL SERVICES LAW TO THE FREELANCING INDUSTRY
June 2...
This is the date that the course of freelancing will be changed as the Digital Services Law is implemented.
The Digital Services Law is aimed at creating a safer, fairer, and more transparent digital space. While these laws generally address non-resident large online platforms and digital service providers, they can have ripple effects on the freelancing industry.
Below are some positive and negative implications for freelancers:
Positive Implications --- Yes, it has some. :)
1. Increased Client Trust and Credibility
By enforcing transparency in online platforms, the DSL builds trust among clients and freelancers. Clearer guidelines on how platforms handle disputes, content moderation, and reviews foster confidence in digital marketplaces like Upwork, Fiverr, or LinkedIn. Though most platforms already have these policies. They might up-ed their guidelines because of DSL. This will encourage accountability for both the platform and freelancers leading to a potential increased trustworthiness of the platform producers. This can increase client trust.
2. Improved Platform Accountability
As mentioned above, freelancing platforms must ensure fair treatment of freelancers, including transparent algorithms for job matches and dispute resolution processes. This reduces the likelihood of arbitrary account suspensions or unfair practices. There will also be stricter rules for freelancers. Maybe requiring us all to register with BIR moving forwards? These are some of the predicted steps for accountability for taxes to be properly monitored.
3. Economic Tracking of the Freelancing Industry
With proper tax mapping, the freelancing industry's economic contributions can be properly measured. We will be ablle to see our strength and potentially create a voice in our goverment.
4. Standardized Rights and Protections
As digital service providers comply with these laws, freelancers may benefit from standardized contracts, payment protection, and access to legal recourse in case of disputes.
5. Legal Business Registrations for Freelancers
Freelancers can be a legitimate institution where we can be recognized as different social entities. Colorum freelancing services can be regulated.
Negative Implications --- let's go there. :)
1. Increased Costs
Compliance with laws like the DSL might lead platforms to pass on higher operational costs to freelancers in the form of increased fees or subscription charges. Freelancers might face additional administrative burdens, such as compliance with new rules for posting content or marketing services. This could stifle creativity and flexibility, which are hallmarks of freelancing.
2. Potential for Job Market Saturation Leading to even Tougher Competition
Clients might opt to hiring other non-Filipino freelancers, making it tought for Filiponos to complete and potentially driving down rates just to be able to make it.
4. Vulnerability to Algorithmic Changes
The requirement for algorithm transparency might lead platforms to make adjustments that inadvertently affect freelancersโ visibility, creating uncertainty in securing projects.
5. Conflicts Across Jurisdictions
Freelancers working internationally may encounter complexities in adhering to varying digital service laws in different countries, leading to confusion, legal risks, vague policies, and being double taxed.
In conclusion, the DSL have different positive and negative implications. No matter what, it looks like this law is here to stay. Freelancers are one the most who will be hugely hit bt this. Moreso, lacking relevant laws and policies for this very industry.
How about you? What do you think of this. Will this bring positive or negative results?
