What if a regular holiday falls on a special non-working holiday just like the case of August 21, 2018?

If worked, an employee will get:
200% (Basic pay + COLA) + 30% (Basic pay X 200%)

This is also equivalent to the 260% of your basic pay plus twice of your COLA.

Under Art. 87 of the Labor Code, employees who render their services in excess of 8 hours a day shall be entitled to Overtime pay of additional 25% thereof, provided that, compressed workweek is NOT implemented in the establishment.

However, some employers do NOT pay the overtime work of their employees. To compensate, they allow the Employee to offset the extra hours they worked by leaving early on some other day. This is NOT allowed under Art. 88. of the Labor Code. Offsetting shall NOT exempt the employer from paying overtime work.

As per Art. 89 of the Labor code, an employee may be required by the employer to perform overtime work when:

1. The work is necessary to prevent serious loss or damage to the business or operations of the employer such as urgent work on machines, installations or perishable goods;

2. The work is necessary to prevent loss of life or property due to serious accidents or natural calamities;

3. There is a declared national or local emergency or the country is at war.

The employee can be charged with "Insubordination" if he willfully refuses to render overtime work for any of the above circumstances.

If the employee was NOT required by his employer to work overtime, then he shall NOT be entitled to overtime pay.

Take note that Managerial employees (as defined in the Labor Code) and field personnel or those unsupervised by their employers are NOT entitled to overtime pay.

Normally, we spend 9 hours in the workplace including a 1-hour break period which is unpaid.

Nonetheless, according to the Implementing Rules of the Labor Code (Sec. 7, Book 3, Rule 1), this 1-hour meal period can be shortened and become paid.

The shortened meal period can be credited as a compensable working hour, provided that it is NOT lesser than 20 minutes.

This shortened meal period can only be implemented when:

1. The work is non-manual in nature or does NOT involve strenuous physical exertion;

2. The establishment regularly operates NOT less than 16 hours a day;

3. There is work needed to be performed on machineries to avoid serious loss to the employer; and

4. The work is NECESSARY to prevent serious loss of perishable goods.

So instead of spending 9 hours at work (8-hours of work + 1-hour meal period), the employee will only spend 8 hours of work inclusive of the 20-minute meal period.

For employed members, the benefit is ADVANCED by the employer to the qualified employee, IN FULL, within 30 DAYS from the date of filing of the maternity leave application.

For separated/voluntary/self-employed members, the amount of benefit is paid DIRECTLY to them by the SSS.

Benefit Computation:

1. Exclude the semester of contingency (delivery or miscarriage). A semester refers to two consecutive quarters or 6 months.

Example: The SSS member is expected to give birth on December 2019.

The semester of contingency would be from July 2019 to December 2019.

The 12-month period before the semester of contingency would be from July 2018 to June 2019.

2. Add the 6 highest monthly salary credits (refer to SSS Contribution table) within the 12-month period before the semester of contingency to get the total monthly salary credit.

Example: The SSS member is regularly receiving the minimum rate (P13,962) from the past 1 year up to date, her monthly salary credit based on the SSS Contribution table is equivalent to P14,000. So P14,000 x 6 = P84,000

3. Divide the total monthly salary credit by 180 days to get the daily maternity allowance.

Example: P84,000/180 = P466.67

4. Multiply the daily maternity allowance by 105 days for livebirth or 60 days for miscarriage to get the total amount of maternity benefit.

Example: P466.67 x 105 = P49,000
