Please be advised that the Securities and Exchange Commission (SEC) will implement a new online system called the MC 28 Submission Portal. The portal can be accessed through https://apps010.sec.gov.ph

Starting January 17, 2022, compliance in the filing of Memorandum Circular No. 28, Series of 2020 must be submitted using the said portal.

Those submitted via electronic mail ([email protected]) prior to January 17, 2022 will still be processed, unless the applicant is notified by the SEC Monitoring Officer.

EXTENSION ON SUBMISSION OF FORMS/NOTICES MC 28

In view of the Commission’s effort to bolster the economic recovery of the business sector during the pandemic, the SEC has extended the deadline for Corporations, Partnerships, and Individuals under the jurisdiction and supervision of the Commission to comply with SEC Memorandum Circular No. 28, series of 2020, without penalty, until November 11, 2021.

You may file the forms/notices of the MC 28, s. 2020 online through the email platform [email protected].

Filing of the forms/notices beyond November 11, 2021 shall be considered as noncompliant and will be subject to penalty in the amount of P10,000.00.

SUBMIT YOUR MC28 REPORT BY AUGUST 31

Submit your official and alternate email addresses and mobile phone numbers to the Securities and Exchange Commission (SEC) on or before August 31, 2021 to avoid the applicable penalties.

Send in your official and alternate contact numbers via email at [email protected], or submit a hard copy at the SEC Main Office or Extension Offices.

For the SEC Main Office within the PICC Complex at Pasay City, secure an appointment first at https://sesas.secexpress.ph/. Meanwhile, make sure to follow the protocols adopted by the extension offices in accordance with the quarantine classification in their respective areas.

All corporations, associations, partnerships and persons under the jurisdiction of the SEC are required to submit their official and alternate email addresses and mobile phone numbers, pursuant to SEC Memorandum Circular No. 28, Series of 2020 (MC 28).

The Bureau of Internal Revenue (BIR) has recently issued Revenue Memorandum Circular (RMC) No. 88-2021 circularizing the lists of Top Withholding Agents (TWAs) required to deduct and remit the 1% or 2% Creditable Withholding Tax (CWT) for the purchase of goods and services under Revenue Regulations No. 31-2020.
👉 The obligation to deduct and remit the CWT shall continue, commence or cease, as the case may be effective August 1, 2021. Any taxpayer not found in the published list of TWAs is deemed excluded.
👉 The publication of the list of TWAs in the newspaper of general circulation is deemed sufficient proof of being identified as a TWA.
👉 TWAs, at their option, can file a written request for a separate documentary proof/certification which shall be made with their respective Revenue District Office where the TWA is registered.
