Isip pagpadayon sa atong โLEX BUMBEROโ legal advisory series karong Womenโs Month, atong hisgutan ang Republic Act No. 9262 o ang Anti-Violence Against Women and Their Children Act of 2004. Ang Bureau of Fire Protection โ Region 7 nagbarog uban sa balaod sa pagpanalipod sa dignidad ug seguridad sa matag pamilya.
Ania ang mga angay ninyong mahibaloan:
โ Unsa kining RA 9262 o ang Anti-VAWC Act?
โ
It is a law that addresses violence committed against women and their children by their intimate partners, such as a husband, ex-husband, live-in partner, or dating partner.
โ Kinsa man ang protektado niining balaora?
โ
The law protects wives, former wives, women with whom the offender has or had a sexual or dating relationship, or those with whom the offender has a common child. It also protects their children (below 18, or older but incapable of self-care).
โ
RA 9262 covers four main types of violence:
1. Physical Violence (bodily harm).
2. Sexual Violence (acts sexual in nature, including harassment and prostituting the woman or child).
3. Psychological Violence (acts causing mental or emotional suffering, such as stalking, public ridicule, or denial of financial support).
4. Economic Abuse (acts that make the woman financially dependent, like controlling her money or preventing her from working).
โ
No. While the law primarily protects women and children, women (such as le***an partners or former partners) can also be held liable if they commit acts of violence against their female partners.
โ Unsa kining "Protection Order"?
โ
It is an order issued to prevent further acts of violence and provide relief to the victim. There are three kinds: Barangay Protection Order (BPO), Temporary Protection Order (TPO), and Permanent Protection Order (PPO).
โ
Yes. Victims under RA 9262 are entitled to a paid leave of absence of up to ten (10) days in addition to other paid leaves under Civil Service Rules. This can be extended as specified in a protection order.
โ Unsa man kining "Battered Woman Syndrome" (BWS)?
โ
It refers to a scientifically defined pattern of psychological and behavioral symptoms found in women living in battering relationships as a result of cumulative abuse.
โ
Any victim who suffers from BWS should be diagnosed by a psychiatric expert or a clinical psychologist. The law mandates that in determining the state of mind of the woman, the courts shall be assisted by these experts.
โ
Yes. Victim-survivors who are found by the courts to be suffering from BWS do not incur any criminal and civil liability, even if some elements of self-defense under the Revised Penal Code are missing. The law acknowledges that women may commit violence as a form of self-defense after long history of abuse.
โ
No. Suffering from Battered Woman Syndrome will not automatically disqualify a woman from having custody of her children. Their care is entrusted to the woman even if she is found to have BWS, unless the court finds other compelling reasons.
โ
No. The law explicitly states that in no case shall the custody of minor children be given to the perpetrator of a woman who is suffering from Battered Woman Syndrome.
โ Asa pwede mangayo og tabang?
