Ang Article 649 naghisgot bahin sa legal nga right of way o agianan para sa yuta nga walay agi padulong sa public road.

Simpleng Pasabot
Kung ang imong yuta:
napalibutan sa laing mga yuta,
ug walay igo nga dalan paingon sa karsada o public road, naa kay katungod nga mangayo ug agianan (right of way) gikan sa silingan nga yuta, basta:

kinahanglan gyud ang agianan,
ug mobayad ka ug hustong bayad o indemnity sa tag-iya sa yuta nga maagian.

Mga Requirement aron makapangayo ug Right of Way
Landlocked ang yuta
Walay sakto nga access sa public road.
Kinahanglanon gyud ang agianan
Dili lang kay gusto nimo shortcut.
Naay bayad sa naapektuhan nga owner
Dili libre ang pag-agi.
Pinakagamay nga samok o damage
Ang agianan dapat didto sa lugar nga dili kaayo makadaot sa silingan.

Pananglitan: Naa kay yuta sa sulod sa subdivision o bukid nga napalibotan sa laing owners unya walay dalan paingon highway.

Pwede ka mohangyo ug legal nga agianan sa silingan aron makaagi ang sakyanan o tawo. Pero kinahanglan:
reasonable ang agianan,
ug mobayad ka sa owner sa yuta nga maagian.

As someone holding both licenses (REC and REB), let’s clear up the confusion so you know who you are talking to!

1. The Real Estate BROKER (REB) 🤝
The "Deal Maker": The Broker’s primary role is to act as an agent in a real estate transaction—whether buying, selling, or leasing.

The Goal: To close the sale and ensure all documents (titles, taxes, and contracts) are handled correctly.

When to call a Broker: Kung nangita ka og balay, yuta, o condo nga palitunon, o kung gusto nimo ibaligya ang imong property.

2. The Real Estate CONSULTANT (REC) 🧠
The "Strategist": This is a higher level of expertise. A Consultant does not just "sell"; they provide professional advice, judgment, and specialized technical services.

The Goal: To conduct feasibility studies, market trend analysis, and provide long-term investment strategies.

The Catch: To become a Licensed Consultant, one must have at least 10 years of experience as a Broker first!

When to call a Consultant: Kung kinahanglan nimo mahibaloan kung "Highest and Best Use" ba ang imong yuta, o kung dako ba ang return on investment (ROI) sa usa ka project sa dili pa ka mo-invest og milyon-milyon.

⚠️ The "Property Consultant" Confusion
Many unlicensed practitioners or salespersons call themselves "Property Consultants" to sound professional. However, under the law:

Real Estate Salespersons must work under a Licensed Broker.

Licensed Consultants (REC) have passed a rigorous board exam and possess years of technical mastery.

Why does this matter to YOU?
Protect your hard-earned money. Always ask for a PRC License. A licensed professional (REC/REA/REB) is accountable to the law and to a Code of Ethics.

🚨 OFFICIAL: 5-month freeze on Land Conversion (DA Circular No. 1, s. 2026)

The Department of Agriculture has officially hit the "Pause" button. If you are in the middle of a project or planning to reclassify agricultural land, the rules just changed until June 2026.

The Facts (Per Manila Bulletin/DA):

• New Applications: Suspended immediately. No new submissions will be accepted until the moratorium ends.
• In-Process Applications: If you filed before the effectivity date, your processing continues.
• Pending Appeals: Currently held in abeyance (on hold).

The Takeaway: Agriculture Secretary Tiu Laurel noted: “The DA does not want land reclassification unless there is a replacement land that can be irrigated.”

While this news is challenging, it's also an opportunity to refine our strategies. Looking at this from both a technical and consultancy perspective, here is what I suggest we focus on:

• For Developers: Now is the time to audit your "Land Use Plan" maps to ensure they meet the new "thorough review process" mentioned by the DA.
