According to RA 8749 or also known as the Philippine Clean Air Act of 1999 and its IRR, the DENR Administrative Order (DAO) 2004-26, all sources of air pollution must have a valid Permit to Operate.

Pursuant to PD 1586 and its IRR, the DENR Administrative Order (DAO) 2003-30, the Environmental Compliance Certificate (ECC) refers to the document certifying that based on the representations of the proponent and the preparers, as reviewed and validated by the Environmental Impact Assessment Review Committee (EIARC), the proposed project or undertaking will not cause a significant negative environmental impact; that the proponent has complied with all the requirements of the Environmental Impact Assessment (EIA) System; and that the proponent is committed to implement its approved Environmental Management Plan in the Environmental Impact Statement or mitigation measures in the Initial Environmental Examination (IEE).

Without an ECC and/ or other applicable permits, undertaking a project within environmentally critical area or environmentally critical project is considered illegal and may result in severe penalties, including fines and suspension of operations.
