Ito ang Position Paper ng UP Gender Law and Policy Program (UP GLPP)—kasama ang mga abogado, policy experts, at women’s rights advocates—na nananawagan para sa isang makatao, makatarungan, at inclusive na Divorce Law sa Pilipinas.

Hindi ito tungkol sa pagpapadali ng hiwalayan.
Ito ay tungkol sa pagbibigay ng paraan para makalaya ang mga taong nasa mapanirang relasyon.

Ano ang malinaw sa papel na ito?

📌 Human rights-centered ang divorce – naka-align sa international commitments ng Pilipinas (CEDAW, ICCPR) para protektahan ang dignidad ng bawat isa.
📌 Hindi basta-basta ang divorce – judicial process ito, at para lang sa mga kasal na irreparably broken.
📌 Walang discrimination – protektado ang lahat, regardless of gender, SOGIE, religion, health status, o social class.
📌 Hindi kasalanan ang pagiging LGBTQ+ – sexual orientation alone is NOT a ground for divorce.
📌 May safeguards laban sa abuse – kasama ang protection orders at iba pang legal remedies.
📌 Child-centered ang approach – laging inuuna ang best interests ng bata.
📌 Inclusive at accessible – may consideration sa OFWs (online hearings) at Indigenous Peoples.
📌 May suporta kahit pagkatapos ng divorce – hindi ka pababayaan after makalaya.

At ang pinaka-importante:
Ang pamilya ay hindi pinapatibay sa pamamagitan ng pagpilit sa mga tao na manatili sa abuso.

We urge the 20th Congress:
Ipasa na ang Divorce Bill.

Because dignity, safety, and freedom should never be optional.
