Hindi porket family business o below 5 employees ang isang negosyo ay automatic nang exempt sa labor laws sa Pilipinas.

Marami ang nag-aakala na kapag maliit o “pamilya lang” ang setup, hindi na covered ng labor standards—pero mali ito.

Ang basehan ng labor law ay hindi size o relasyon, kundi:

✔ May trabaho na ginagawa
✔ May employer control (schedule, supervision, instructions)
✔ May bayad na kapalit ng serbisyo

Kapag nandiyan ang elements na ito, may employer-employee relationship na.

Kahit small business or family business, required pa rin ang:

✔ Minimum wage (regional/provincial wage rate)
✔ Overtime pay, holiday pay, at Service Incentive Leave (kung applicable)
✔ Mandatory government contributions:

* SSS
* PhilHealth
* Pag-IBIG

✔ Safe working conditions
✔ Basic employee rights

⚠️ Common misconception:

❌ “Below 5 employees = exempt na sa labor laws”
❌ “Family business = no need maghulog or sumunod sa labor standards”

👉 Hindi ito automatic exemption.

May ilang limited exemptions or special rules lang sa certain establishments (hal. micro businesses or specific retail/service setups), pero hindi ito blanket exemption sa lahat ng labor obligations.

Kapag may:

✔ registered business
✔ actual operations
✔ employees kahit 1–5 pa yan
✔ structured work arrangement

➡️ Covered pa rin ng labor standards.

BOTTOM LINE:

Hindi basehan ang laki ng negosyo o pagiging family business.
