🇺🇸 WANT TO WORK LEGALLY IN THE UNITED STATES? HERE'S WHAT YOU SHOULD KNOW ABOUT U.S. WORK VISAS.

One of the questions we frequently receive is:
“How can I get a work visa for the United States?”

The first thing to understand is that there is no single U.S. “work visa.” There are several different employment-based visa categories, and the right one depends on your occupation, qualifications, employer, and whether you intend to work in the United States temporarily or permanently.

🔹 H-1B – Specialty Occupations
Generally for professional positions requiring specialized knowledge and normally at least a bachelor's degree or its equivalent in a related field. Many H-1B positions are subject to an annual numerical limit and registration/selection process.

🔹 H-2A – Temporary Agricultural Workers
For temporary or seasonal agricultural employment when qualified U.S. workers are unavailable.

🔹 H-2B – Temporary Non-Agricultural Workers
For qualifying temporary or seasonal non-agricultural jobs. These visas are also subject to numerical limitations.

🔹 L-1 – Intracompany Transferees
For certain employees of an international company who are being transferred to a related U.S. office as managers, executives, or employees with specialized knowledge.

🔹 O-1 – Extraordinary Ability
For individuals who can demonstrate extraordinary ability or achievement in fields such as science, education, business, athletics, or the arts.

🔹 Employment-Based Immigrant Visas (Green Cards)
Certain workers may also qualify for permanent residence through employment under categories such as EB-1, EB-2 and EB-3. Some cases require an employer sponsor and labor certification, while certain categories may permit other avenues.

📋 WHAT ARE THE BASIC REQUIREMENTS?
Requirements vary considerably, but for many temporary employment visas, you will generally need:

✅ A qualifying U.S. employer or petitioner
✅ A legitimate job or qualifying position in the United States
✅ An approved petition from USCIS when required
✅ Evidence that you meet the education, training, experience or other qualifications for the position
✅ A valid passport and required visa documentation
✅ A visa interview and eligibility for admission to the United States
Important: Simply receiving a job offer does not automatically guarantee approval of a work visa.

💵 HOW MUCH DOES IT COST?

Government fees depend heavily on the visa category and employer.

For many petition-based temporary worker visas—including H, L, O, P, Q and R—the current U.S. Department of State visa application fee is $205.

There are usually separate USCIS petition fees paid during the employer/petitioner stage, and depending upon the visa category and employer, additional government fees can apply. Attorney's fees, medical examinations, document preparation, translations, travel and other expenses may also be separate.

For employment-based immigrant visas processed through a U.S. Embassy or Consulate, the current immigrant visa application processing fee is $345 per applicant, in addition to applicable USCIS petition fees and other expenses.

⏳ HOW LONG DOES IT TAKE?

There is no single processing time for a U.S. work visa.
Some cases may be completed within a few months, while others may take considerably longer. Timing can depend on:

• The type of work visa
• USCIS processing times
• Whether a numerical visa limit applies
• Availability of visas under the Visa Bulletin, when applicable
• Employer and Department of Labor requirements
• Requests for additional evidence
• U.S. Embassy interview availability
• Administrative processing or additional security review

Some eligible USCIS petitions may qualify for Premium Processing, which can substantially shorten the USCIS petition stage for an additional government fee. It does not, however, guarantee visa approval or eliminate the separate consular process.

⚠️ BE CAREFUL WITH “GUARANTEED U.S. JOB” OR “GUARANTEED WORK VISA” OFFERS

A legitimate U.S. work visa has specific legal requirements. Be especially cautious about anyone promising a “guaranteed visa” in exchange for a large upfront payment.
