2026 YLR 178 – اپیل میں عدالتی ریکارڈ کی اہمیت

عدالتِ عالیہ نے قرار دیا ہے کہ اگر اپیل کے ساتھ اصل عدالتی ریکارڈ پہلے ہی دستیاب ہو تو صرف رسمی طور پر دوبارہ ریکارڈ طلب کرنا ضروری نہیں۔ اپیلیٹ کورٹ دستیاب ریکارڈ کا جائزہ لے کر قانون کے مطابق فیصلہ کر سکتی ہے، بشرطیکہ مکمل ریکارڈ انصاف کے تقاضے پورے کرنے کے لیے کافی ہو۔

📜 Important Legal Principle on Dowry Items
According to 2023 MLD 92, dowry articles are the exclusive property of the wife, and only she can claim their return during her lifetime.
💔 If the wife passes away without initiating any legal action, her heirs and husband cannot claim the return of dowry items in her place.
