Fate of a honor killing reported case. Rose Law Company pleaded a case on 23/10/2013 in Honorable Lahore High Court Lahore of Mst Attia Batool resident of sargodha who was murdered by his real father on 28/09/2009 and case was registered against his father vide FIR no.326/2009.Mr Sajjad haider murder his daughter and her lover in his own house and the deceased family registered a case against Sajjad Haider under section 302(b)PPC. The case was trial in session court sargodha and sajjad haider was sentenced to death on two counts with a direction to pay Rs.50000/- as compensation under section 544-A, code of Criminal procedure, to the legal heirs of Mubassahar Manzor(deceased). Sajjad Haider(appellant) has filed the appeal in hands whereas the learned trial court has sent murder reference No.220 of 2010 for confirmation or otherwise of the sentence of death awarded to sajjad haider(appellant), as required under section 374, code of criminal procedure. as both these matters have arisen out of the same judgement,therefore, shall be decided together through his single judgement.
After hearing the case the Honorable Judges declared in their judgement that the witness or not eye witness, the medical report does not support the version of prosecution and the story of the police also creates some doubts.
It is important to mention here that the accused Mr. Sajjad Haider himself gave his first statement to the police that he killed his daughter Mst Attia Batool and Mubasshar Manzoor even his lawyer pleaded his case that my client murder both of above on account of honor killing. The honorable judges pass the judgement as under :
"1: for the foregoing reasons, this appeal is allowed. conviction and sentence awarded to the appellant vide judgement dated 31/03/2010 passed by the learned Additional Session Judge, sargodha is hereby set aside. The appellant is acquitted of the charge leveled against him while extending him benefit of doubt. He is in jail. He be released forthwith if not required to be detained in any other case.
2: murder reference no.220 of 2010 is answered in the NEGATIVE and the sentence of death awarded to Sajjad Haider (convict) is NOT CONFIRMED."
this is the fate of a honor killing case. The question arises,
1: If Sajjad haider was falsely involved in this murder case and he remains behind the bar for 4 years and the court declared that he is innocent then who is responsible for his detention?
2: if sajjad haider does not kill his daughter and mubasshar manzoor then who killed them because police investigation , medical report have loops hole therefore the accused was declared innocent.
Conclusion:
It is suggested that drastic amendments may be made in the present criminal justice system to punished the real culprits. Who will realize this all? (ZARA SOCHIYE) Please think over it.
