Portugal Nationality Law Article 7 — Transitional Protection (Application in Time)
Article 7 is currently one of the most important articles for immigrants who have been waiting for many years due to SEF and AIMA delays.
This article says that:
“Pending administrative procedures” existing before the new law entered into force may continue under the previous nationality law framework.
Simple meaning:
If a person already had an administrative process underway before the new law took effect, there may still be an argument that the old law should apply to that case.
This is very important for people who:
• opened Expression of Interest years ago
• waited long due to SEF/AIMA backlog
• paid taxes and Social Security
• invested and integrated into Portugal
• but received residence permits very late because of administrative delay
The biggest question now is:
Will pending AIMA and SEF legalisation procedures be considered protected under Article 7 or not?
At the moment, the law does not clearly define this point, and future regulation, IRN interpretation, and Administrative Court decisions may become very important.
