UNITED STATES: Trade / Suspended Secondary Tariffs

If you ship to the US from India, China or Türkiye, how much warning would you get before an extra 100 per cent tariff took effect?

On 16 October, President Trump waived the new tariffs and sanctions in the Graham Act, a Russia and Iran sanctions law signed on 18 September. Existing executive-order sanctions on Russia stay in force.

The order still sets the rate. Goods from any of the five largest importers of Russian crude or gas would face an extra 100 per cent if that country keeps buying from 18 October. Congressional committees must receive a written justification at least ten days before such duties are imposed.

In April 2019, buyers of Iranian oil had ten days' notice that their US exemptions would not be renewed. India had stopped buying by late May. This waiver has no expiry date, and the law sets no notice period for lifting it.

Manufacturers, importers and distributors with plants or suppliers in China, India, Türkiye or other large buyers of Russian energy should establish which US-bound goods would count as originating there. They should also track the purchase data and policy signals that would precede a reversal, since no notice is owed to them.

UNITED STATES: Sanctions / Hidden Blacklist

What happens when your bank can see a blacklist that you cannot?

Washington has sanctioned the A7 network, a Russia-linked payment system it says Iran's central bank also uses, and proposed barring US banks from any transfer involving its sub-agents, a ban that could take effect after 4 November. The Treasury counts hundreds of sub-agents, banking at about 435 institutions in at least 83 countries.

Its full list would go to banks, not clients, so a supplier may first learn a counterparty is on it when its bank declines a payment and, under the rule, explains why. The Treasury says even Kyrgyzstan's state-owned trading company has paid on the network's behalf.

Exposure needs no Russian trade: the agents move dollars, euros, yuan and dirhams through ordinary banks. In January 2025, Washington sanctioned Kyrgyzstan's Keremet Bank for moving payments for A7's Russian co-owner, suggesting banks serving the network may be next.

Exporters, importers and traders paying through agents in the UAE, Hong Kong, Türkiye, Kyrgyzstan or Indonesia should establish who ultimately controls those agents before their bank's screening does it for them, since the Treasury says the network fronts its companies with non-Russian owners and tailors them to each client's industry.

EUROPE: Energy Security / Diesel Supply

If your diesel had to come from a new supplier next month, could you prove the crude behind it was not Russian?

On 29 September, Washington announced another 40 million barrels from reserves and said several European countries had delivered only a fraction of what they pledged. It is also weighing a 90-day ban on diesel exports before the November elections.

Since 2022 the United States and the Gulf have replaced Russia, once the source of about 40 percent of Europe's imported diesel. Gulf supply now faces a disrupted Hormuz, and since 21 January the European Union has banned fuel refined from Russian crude in third countries, requiring enhanced due diligence on cargoes from India and Turkey.

The government urging Europe to release more reserves is weighing limits on the diesel Europe buys from it, and the nearest substitutes arrive with a compliance test attached. A supply problem can become a sanctions problem with a single supplier change.

Operators with fleets, plants or logistics networks in Europe should map the origin behind every diesel contract now and write crude-origin guarantees into any replacement supply, before a decision in Washington forces the switch at short notice.
