A number of food additives is intended to be excluded from the technical regulation TR CU 029/2012

The EEC Board is discussing the issue of exclusion from the technical regulation "Safety requirements for food additives, flavors and technological aids" (TR CU 029/2012) of a number of food additives.
It is about 19 food additives that are currently approved for use by the technical regulations, but as scientific studies of recent years have shown, they have a negative effect.
In this regard, as the EEC Minister said, technical regulations will include 6 new additives, and the list of enzyme preparations, including those of microbiological origin, as well as the list of flavoring substances for manufacture of food flavors, will be significantly expanded.

THE MINISTRY OF INDUSTRY AND TRADE OF THE RUSSIAN FEDERATION IS PREPARING AMENDMENTS TO THE TECHNICAL REGULATION TR CU 010/2011

The Ministry of Industry and Trade of the Russian Federation is developing amendments to the technical regulation "On the safety of machinery and equipment" (TR CU 010/2011) regarding the inclusion of electronic means of individual mobility (EMIM - electric scooter, electric skateboard, gyro scooter, segway, unicycle) to the list of mandatory certification.

According to organizers of International Industry Conference of Micromobility, the state standard GOST R 70514-2022 “Electric means of individual mobility. Technical requirements and test methods” recently entered into force, can be included in the list of standards that ensure compliance with the requirements of TR CU 010/2011. For security purposes, requirements for EMIM will become mandatory, and manufacturers will be required to certify their products.

Pursuant to industry representatives, there are still no laboratories in the Russian Federation that can conduct research and have the equipment necessary for these purposes.

AMENDMENTS TO TR CU 004/2011 "ON THE SAFETY OF LOW-VOLTAGE EQUIPMENT" AND TR CU 020/2011 "ELECTROMAGNETIC COMPATIBILITY OF TECHNICAL MEANS"
I. Main amendments affecting TR CU 004/2011
1. The list of products that are not covered by the regulation has been expanded:
- The regulation does not include components of low-voltage equipment (assemblies, components and components), the safety of which is partially or completely determined by how these components are built into other electrical equipment, and cannot be assessed (tested) otherwise than as part of this equipment.
- Equipment subject to the regulations "On the safety of machinery and equipment" (TR CU 010/2011), "Safety of elevators" (TR CU 011/2011) and "On the safety of equipment for operation in explosive atmospheres" (TR CU 012/2011), except for cables, wires and cords, which are still covered by TR CU 004/2011.

II. Main amendments affecting TR CU 020/2011
1. The list of products that are not covered by the regulation has been expanded:
Exceptions: medical devices, used equipment, defense products and specially designed to ensure safety in the field of atomic energy use.
2. Clarifications introduced in Appendix No. 3:
Certification is required for:
- system units,
- cash registers that work in conjunction with a computer,
- technical equipment not only for household, but also for office purposes, connected to personal electronic computers.

New lists of products subject to mandatory certification and declaration in Russia

On September 1, 2022, Decree of the Government of the Russian Federation No. 2425 of December 23, 2021 comes into force, approving new lists of goods subject to mandatory certification and mandatory declaration.

Until 01.09.2022, goods subject to mandatory certification and declaration in Russia have been listed in Decree 982 of December 1, 2009.

The new Decree 2425 deals with goods that are not subject to any technical regulation of the EAEU, but are still subject to mandatory conformity assessment in Russia according to local standards.
On such goods, after the quality assurance procedure, the Russian mark of circulation on the market (STR), and not the Eurasian mark (EAC) is applied.

The structural changes in the new lists are as follows:
- for products, specific national and interstate standards are now indicated that are used while assessing;
- instead of product codes according to the old Russian classifier OK 005-93, HS codes are indicated;
- all positions in the new lists are simply numbered in order, without reference to the product code.

As for the content itself, the new lists in Decree 2425 have almost 2 times more items. However, this is not due to the apprance of new types of products, but due to the detailing of the existing ones.

Changes to the technical regulations TR CU 004 and TR CU 020

For the technical regulations "On the safety of low-voltage equipment" (TR TS 004/2011) and "Electromagnetic compatibility of technical equipment" (TR TS 020/2011), transitional periods have been established in terms of amendments that will come into force on December 11, 2022.

The main changes that will be made to the Technical Regulations 020/2011 and 004/2011:

Changes in TR CU 004/2011.
The following items will be excluded from the product list:
- low-voltage equipment covered by TR CU 010/2011, TR CU 011/2011, TR CU 012/2011, except for cables, wires, cords
- equipment that is not intended for sale;
- built-in units, accessories and components

Changes in TR CU 020/2011.
The following items will be added to the list:
- cash registers, including those working in conjunction with a computer;
- copiers (including multifunction devices).

Technical means operating only from an independent power source with a rated voltage of not more than 6V DC will be excluded.

THE LIST OF PRODUCTS NOT SUBJECT TO SIMPLIFIED DECLARATION HAS BEEN UPDATED

Order No. 1003 of the Ministry of Industry and Trade of Russia dated March 25, 2022 approved a list of products that are not subject to simplified declaration procedure according to the Decree of the Government of the Russian Federation No. 353 dated March 12, 2022 “On the specifics of licensing activities in the Russian Federation in 2022 ”.

The list includes products necessary for industry and essential goods, which must necessarily comply with the requirements of the technical regulations of the economic union.

The list will be supplemented with new types of products, taking into account their priority for the domestic industry, the conditions for their import, as well as the possibility of their import substitution.

It is possible to check whether a product is included in the list of the Ministry of Industry and Trade of Russia, knowing its name or HS Code. If the product is included in the list, the simplified declaration scheme cannot be applied to it.

SIMPLIFIED DECLARATION PROCEDURE

On the FSA website there is an opportunity to check whether it is possible to issue a simplified declaration for a product in accordance with Decree 353 of the Government of the Russian Federation. To do this, you just need to enter the HS code (if you know) or the name of your product. If your product is on the list of products subject to simplified declaration, then you can issue a simplified declaration.

How to issue a simplified declaration?It can be issued instead of a certificate in the period from March 12, 2022 to September 1, 2022, valid for no more than 6 months. In this case, the products can only be sold during the validity period of the declaration.

Important! You can only declare a batch or a single product.Such products are not marked with the EAC circulation mark, and cannot be sold in countries other than Russia.Also, for the subsequent certification of goods imported with a simplified declaration, it is not necessary to have test samples. Сhanges to the technical regulations for low-voltage equipment

The EEC Board approved amendments to the technical regulation "On the safety of low-voltage equipment" (TR CU 004/2011).
Some definitions have been changed, including changes to the definition of "low voltage equipment".
Now the technical regulation does not apply to equipment that is subject to the technical regulations TR CU 010/2011, TR CU 011/2011, TR CU 012/2011 with the exception of cables, wires, cords.

The list of products to TR CU 004/2011 subject to mandatory certification has also been changed. Apparatus for distributing electrical energy and electrical apparatus for controlling electrical installations were excluded from the list. The list of TR CU 004/2011 products now includes automatic control devices for household electrical equipment, consoles and control panels, controllers.

REQUIREMENTS FOR THE COMPOSITION OF PERFUMERY AND COSMETIC PRODUCTS HAVE BEEN CHANGED
The EEC Council adopted amendments to the technical regulation “On the safety of perfumery and cosmetic products” (TR CU 009/2011).
The list of substances permitted for the production of perfumery and cosmetics has been changed, as well as the list of substances for which a ban has been launched.
The revised list of prohibited substances increased by 296 positions. 12 items were added to the list of substances allowed for use in perfumery and cosmetic products, and 6 items were excluded.
4 chemicals were excluded from the list of permitted preservatives.

SIMPLIFIED PRODUCT CERTIFICATION PROCEDURE IN 2022

Decree of the Government of the Russian Federation dated March 12, 2022 No. 353 "On the specifics of certification activities in the Russian Federation in 2022" came into force.

One of the main points of the decree:

- a simplified declaration regime is being introduced for new manufacturers and suppliers. In this regard, it is allowed not to undergo certification, but to issue declarations of conformity for batch with 6 months validity period based on your own evidence. Documents issued by foreign certification bodies or laboratories can serve as evidence of product safety.

Please note that this paragraph does not apply to certain products: pyrotechnics, agricultural machinery, snow and swamp vehicles and snowmobiles, elevators, tractors and components for them, weapons, central heating radiators and convectors, cement, pesticides, goods for children - toys, strollers and bicycles, light industry products, products for care and hygiene.

- the validity of certificates of conformity which had to be reissued before September 1 of the current year is extended for 1 year;
- for valid certificates that do not expire on September 1, inspection control can be carried out remotely or it can be postponed for six months;
- It is allowed to take samples from an already imported batch of products.
Sampling for the purposes of certification or declaration of conformity, based on evidence obtained with the participation of an accredited laboratory, can be carried out from a batch of products that was imported according to a “simplified” declaration of conformity issued for a batch of products for a period of validity of 6 months.

The adoption of the technical regulation on energy efficiency will be postponed again

The EEC submitted a draft on changing the timing of the entry into force of the technical regulation "On the requirements for the energy efficiency of energy-consuming devices" (TR EAEU 048/2019). It is proposed to postpone the start date of the technical regulation from September 1, 2022 to September 1, 2023. It is also proposed to postpone the entry into force of certain requirements of the technical regulations by 1 year.

Decree of the Government of the Russian Federation No. 2425 “On approval of a unified list of products

On December 23, 2021, Decree of the Government of the Russian Federation No. 2425 “On approval of a unified list of products subject to mandatory certification and a unified list of products subject to declaration of conformity, amendments to Decree of the Government of the Russian Federation of December 31, 2020 No. 2467 and invalidation of some acts of the Government of the Russian Federation”. This resolution enters into force on September 1, 2022, will be valid until September 1, 2028, with the exception of certain provisions for which a different period of their entry into force is provided and will replace the Decree of the Government of the Russian Federation of December 1, 2009 No. 982.

Certificates of conformity for products issued prior to the date of entry into force of this Decree are considered valid until the expiration of the period specified in them, within the limits of the shelf life or service life of products established in accordance with the legislation of the Russian Federation.
