Den 1 juni 2026 börjar nya regler för arbetstillstånd att gälla i Sverige. Regeländringarna består av flera delar som påverkar dig som ska ansöka om eller förlänga arbetstillstånd för en anställning i Sverige.

En av de största förändringarna är ett nytt lönekrav: för att du ska kunna få arbetstillstånd ska din lön vara minst 90 procent av medianlönen i Sverige. Eftersom medianlönen justeras varje år är det den medianlön som var publicerad vid tiden för din ansökan som gäller.

Ett avslag som vändes i nästa steg

Nyligen hanterade jag ett ärende där Migrationsverket först avslog ansökan om uppehållstillstånd och samtidigt fattade beslut om utvisning.

Efter att ha gått igenom ärendet i detalj blev det tydligt att problemet inte låg i själva anställningen, utan i hur underlaget var uppbyggt och vilka uppgifter som saknades eller var otydliga.

Vi kompletterade ärendet och lämnade in ett överklagande.

Migrationsdomstolen upphävde beslutet och skickade tillbaka ärendet för ny prövning.

Efter den nya handläggningen beviljades ett uppehålls- och arbetstillstånd på två år.

Det här är inget ovanligt.

Det handlar sällan om tur.
Det handlar om struktur, tydlighet och att lägga fram rätt underlag från början eller rätta till det i efterhand.

Min erfarenhet är att många avslag hade kunnat undvikas med ett mer genomarbetat upplägg från start.

När systemen granskas som helhet
Sverige har etablerat ett nytt Samhällsråd med uppdrag att stärka samverkan mot organiserad brottslighet. I centrum finns Migrationsverket och dess ansvar för att värna migrations och tillståndssystemets integritet. Det är ett tydligt steg i en utveckling som pågått under en längre tid, där granskning flyttas från enskilda handlingar till hur helheten faktiskt hänger ihop.
Detta handlar inte om nya regler i sig. Det handlar om hur befintliga regler tillämpas när information delas mellan myndigheter, akademi, arbetsmarknadens parter och näringsliv. Ärenden bedöms i sitt sammanhang. Verksamhetens realitet vägs mot det som står i ansökningar, avtal och ekonomiska underlag. Det som tidigare kunde passera som formellt korrekt riskerar nu att ifrågasättas om det saknar förankring i verklig drift.

För företag och arbetsgivare är signalen tydlig. Tillstånd är inte längre en administrativ slutpunkt utan en del av ett större ansvar. Rekryteringsbehov måste vara genuint. Löner och villkor måste spegla faktiska förhållanden. Bolagsstruktur, ekonomi och daglig verksamhet måste hålla ihop över tid. Det är konsekvensen mellan papper och praktik som avgör.
Den här utvecklingen gynnar seriösa aktörer. Företag som byggs med ordning, transparens och långsiktighet får ett starkare skydd i systemet. Samtidigt minskar utrymmet för upplägg som bygger på genvägar, missbruk av regelverk eller tillfälliga konstruktioner som inte tål insyn.

På Make it in Sweden har detta varit utgångspunkten från början. Hållbara tillstånd skapas inte genom att optimera en ansökan, utan genom att bygga verksamheter som fungerar i verkligheten och klarar granskning även när perspektivet vidgas. Det nya Samhällsrådet förstärker den logiken.
För den som gör rätt är detta ingen anledning till oro. Det är snarare en bekräftelse på att systemet rör sig mot större tydlighet, bättre samordning och högre krav på faktisk seriositet. Det är där långsiktigheten finns.

Tăng “trợ cấp hồi hương” áp dụng từ 1/1/2026
Chính phủ Thụy Điển đã quyết định tăng mạnh “trợ cấp hồi hương” dành cho người có giấy phép cư trú vì lý do bảo hộ muốn rời Thụy Điển về nước hoặc sang nước khác nơi mình có quyền cư trú. Hiệu lực từ 1/1/2026.

Mức tiền
350.000 SEK cho mỗi người lớn (từ 18 tuổi).
25.000 SEK cho mỗi trẻ em.
Trần tối đa: 500.000 SEK cho vợ chồng/sống chung; 600.000 SEK cho một hộ gia đình có con.

Đối tượng có thể xin
Người đang cư trú hợp pháp tại Thụy Điển theo diện bảo hộ (tị nạn, kvotflykting, bảo hộ bổ sung) hoặc một số nền tảng pháp lý cũ đã bãi bỏ; thành viên gia đình của các đối tượng này nếu đáp ứng điều kiện kèm theo. Chi tiết sẽ được Migrationsverket hướng dẫn khi quy định có hiệu lực.

Chi trả
Khoản hỗ trợ được giải ngân theo nhiều đợt và gắn với việc thực sự rời Thụy Điển và cư trú tại quốc gia đích trong khoảng thời gian tối thiểu. Cách thức và mốc chi trả cụ thể sẽ do Migrationsverket công bố khi triển khai.

Lưu ý pháp lý
Quy định mới nhằm khuyến khích hồi hương tự nguyện và kèm biện pháp chống gian lận, lạm dụng.

Việc quay lại Thụy Điển sau khi đã nhận tiền có thể phát sinh nghĩa vụ hoàn trả. Chi tiết điều kiện hoàn trả sẽ theo hướng dẫn của Migrationsverket.

*Did you know you can swap your rental apartment in Sweden completely legally and for free?*
If you have a hyresrätt with a förstahandskontrakt, you are allowed to exchange your home with another tenant. It is a lawful and cost-free way to find a better place without losing your contract or waiting years in the housing queue.

*Why consider a swap*
Your current apartment may no longer fit your life. Maybe it is too far from work, too small for your family, or simply not in the area you want to live in anymore. Swapping gives you freedom to move while keeping your rental rights intact.

*Who can swap*
Anyone holding a förstahandskontrakt (first-hand rental contract) can apply for an exchange.
Most landlords require that you have lived in your current apartment for at least 12 months before approving a move.
If your landlord refuses without a valid reason, you can appeal to Hyresnämnden (the Rent Tribunal).

*Basic rules*
Only hyresrätt to hyresrätt exchanges are allowed. Owned apartments or houses are not accepted.
No money or compensation may be offered or accepted. Paid swaps are illegal and can lead to losing your contract.
You must have a valid reason, called beaktansvärda skäl, such as a change in job, income, family size, health, or distance to work or school.

*How to do it right*
Prepare your documents: rental contract, three latest rent receipts, apartment photos, and proof of your reason for moving.
Sign a short principöverenskommelse stating “hyresrätt to hyresrätt, no compensation.”
Send the request to both landlords. If denied without proper grounds, apply directly to Hyresnämnden.

*Where to find people who want to swap*
Lagenhetsbyte.se is Sweden’s main exchange platform.
Hemie.se is a growing site with many listings around the country.
Blocket.se/Bostad has a large audience and high visibility.
There are also Facebook groups such as “Lägenhetsbyte i Göteborg,” “Lägenhetsbyte i Stockholm,” and community pages for residents in Sweden.
Write clear listings with details about area, size, rent, floor, balcony or elevator, and when you are ready to move. Add honest photos and respond quickly to messages.

*Pro tip*
Finding someone who wants to move in the exact opposite direction as you is the hardest part. Be open, patient, and clear. Using byteskedja, a three-way swap, can increase your chances.
If you have had your contract for more than a year and want a home that suits your life better, now is the time to act.

Swapping apartments in Sweden is not complicated when you know your rights and follow the correct steps.

🇸🇪 New update on family reunification in Sweden

The Swedish government is considering stricter conditions for family reunification, with possible implementation from January 1, 2027.

📌 Key proposed changes include:
📍 A two-year waiting period in many cases if the sponsor only holds a temporary residence permit. This will not apply to applications submitted before 2027.
📍 Stricter financial and housing requirements (försörjningskrav), which will also apply when extending permits.
📍 Narrower definition of eligible family members in some cases, especially for couples planning to marry or live together.
📍 Lowering the age for children accompanying labor migrants from 21 to 18.

👉 What this means: If you or your family are planning to apply for reunification in 2026–2027, it is recommended to prepare and submit your application before December 31, 2026, to avoid longer waiting times and stricter conditions.

1. Khái niệm và quyền lợi
Nếu bạn đã sống ở Thụy Điển 5 năm với giấy phép cư trú hoặc cư trú hợp pháp trên một cơ sở khác, bạn có thể nộp đơn xin tình trạng cư trú lâu dài tại Thụy Điển (varaktigt bosatt).
Tình trạng này mang lại cho bạn:
Quyền lợi gần giống công dân EU.
Cơ hội dễ dàng hơn để chuyển sang một quốc gia EU khác để làm việc, học tập, mở doanh nghiệp hoặc sống bằng lương hưu.
Nếu được cấp tình trạng cư trú lâu dài tại Thụy Điển, bạn đồng thời nhận thẻ định cư vĩnh viễn (permanent uppehållstillstånd), trừ khi bạn đã có thẻ này từ trước.
📌 Lưu ý: Khi nộp đơn xin varaktigt bosatt, Migrationsverket chỉ xét yêu cầu này. Họ không xét các diện khác (đoàn tụ gia đình, học tập, làm việc) và cũng không xét việc cấp tình trạng cư trú lâu dài tại một quốc gia EU khác.
2. Điều kiện để được cấp tình trạng cư trú lâu dài
✅ Xác minh được danh tính.
✅ Đã cư trú tại Thụy Điển 5 năm liên tục, không bị gián đoạn.
Có giấy phép cư trú hợp lệ, hoặc cơ sở cư trú hợp pháp khác trong suốt thời gian này.
✅ Có khả năng tự nuôi sống bản thân và gia đình:
Đang làm việc, tự kinh doanh, học tập hoặc có đủ khả năng tài chính lâu dài.
3. Quy định cho thành viên gia đình
Thành viên gia đình không tự động được cấp varaktigt bosatt khi bạn được cấp. Họ phải tự đáp ứng điều kiện.
Nếu con bạn ở Thụy Điển ít hơn 5 năm, con sẽ chưa đủ điều kiện để xin varaktigt bosatt.
Mỗi người phải nộp đơn riêng.
Trường hợp thành viên chưa đủ điều kiện nhưng muốn ở lại Thụy Điển:
Phải nộp đơn xin giấy phép cư trú theo diện đoàn tụ gia đình trước khi giấy phép hiện tại hết hạn.
Bạn phải đáp ứng điều kiện bảo đảm tài chính và chỗ ở phù hợp cho gia đình.
4. Cách tính thời gian 5 năm cư trú
Bạn có thể tính thời gian khi bạn:
Ở Thụy Điển với giấy phép cư trú hợp lệ, trừ giấy phép cho mục đích tạm thời (du lịch, thăm thân, học bậc dưới tiến sĩ).
Cư trú hợp pháp trên cơ sở khác, ví dụ có quyền cư trú hoặc quyền cư trú vĩnh viễn.
📌 Nếu bạn là người tị nạn hoặc được bảo vệ bổ sung, có thể tính từ ngày nộp đơn xin tị nạn hoặc xin xét lại hồ sơ.
5. Thời gian rời Thụy Điển không bị coi là gián đoạn
Không rời Thụy Điển quá 6 tháng liên tiếp.
Tổng thời gian rời Thụy Điển trong 5 năm không quá 10 tháng.
Bao gồm cả công tác và du lịch trong EU.
Gián đoạn cũng xảy ra nếu có khoảng thời gian không có giấy phép cư trú hợp lệ.
6. Nếu giấy phép cư trú sắp hết hạn
Bạn có thể nộp đơn xin varaktigt bosatt khi giấy phép hiện tại còn hiệu lực.
Nếu giấy phép sắp hết hạn, nên nộp đồng thời đơn gia hạn để tránh trường hợp bị từ chối và phải rời Thụy Điển khi không còn giấy phép hợp lệ.
7. Thời gian xử lý
Không có thời gian cố định, phụ thuộc vào việc hồ sơ có đầy đủ hay cần bổ sung, và các kiểm tra liên quan.
75% hồ sơ trong 12 tháng qua có quyết định trong vòng 7 tháng.
8. Lệ phí nộp đơn
Người lớn: 1.000 SEK
Trẻ em: 500 SEK
Không hoàn lại nếu bị từ chối.
Miễn phí cho:
Thành viên gia đình của công dân Bắc Âu.
Công dân EU/EES và gia đình của họ.
Công dân Thụy Sĩ và gia đình của họ.
Công dân Nhật Bản.
📌 Thành viên gia đình của công dân Thụy Điển vẫn phải nộp lệ phí.
