Court seeking to define whether a musician can own the IP rights to a remixed song is nearing summary judgment in California.

Russian DJ Arty accused DJ Marshmello and the British band Bastille of infringing copyright to his remixed song, which he based on the song “I Lived” by OneRepublic.

Under copyright law, derivatives are entitled to their own copyrights but only with respect to original elements.

Lawyers for the DJ Marshmello song argue that DJ Arty relinquished his ownership or financial interest in the OneRepublic song when he signed an agreement that allowed him to compose the remix.

Intel must pay $2.2 billion after a jury found the company guilty of infringing on two patents related to chip making. Lawyers for VLSI Technology accused Intel of “willful blindness,” saying that Intel purposely didn’t question whether it was using inventions owned by VLSI. Intel countered that one patent was invalid because it claimed to cover work done by Intel engineers, adding that the “outrageous” demand by VLSI “would tax the true innovators.”

The lawsuit garnered $1.5 billion for infringement of one patent and $675 million for the second, amounting to one of the largest patent-damages awards in U.S. history.

The single bench of the Delhi High Court, in a suit for injunction against a messaging app by a daily newspaper;

Jagran Prakashan Limited v. Telegram FZ LLC & Ors, CS (COMM) 146/2020, dated May 29, 2020, passed an ad-interim injunction restraining a messaging app for circulating an e-copy of the newspaper through various channels without permission, in violation of the copyright and trademark of the newspaper.

ILLEGAL? Sharing E-Newspaper online and through messaging apps.

Bennett Coleman & Company Limited &Ors. v. Ajay Kumar & Ors(CS(COMM) 21 of 2019, Jan. 16, 2019) India;

Court passed an interim order and prevented a website (www.sscias.com) from downloading e-newspaper copies of Times of India & Economic Times, in a suit filed by Bennett Coleman & Co.

The Defendants were the owners of the website www.sscias.com, an educational website providing study material, including the Delhi editions of Times of India & Economic Times, for its students.

The Delhi High court enjoined the Defendants from copying the E-newspaper in pdf form and making it available to their readers and students for educational purposes, stating that it was an unlawful gain, as it causes revenue loss to these newspapers and severe harm leading to a drop in physical sales as well as online visitors to their website.
