📚 KNOW YOUR MOTIONS — PART 9

⚖️ NEWLY DISCOVERED EVIDENCE

Just because evidence wasn't used in your case doesn't automatically make it “newly discovered.”

But it can be important to find out what was never tested, reviewed, or presented.

🧬 This can be especially important in guilty-plea cases. Sometimes a case ends in a plea before available biological evidence is DNA tested.

That does NOT automatically prove innocence or guarantee a new trial. Courts have specific requirements for newly discovered evidence, and post-conviction DNA testing has its own rules.

Don't assume a guilty plea means there's nothing left to review.

📌 NEW BUSINESS POLICY — EFFECTIVE TODAY

Since starting Legacy Motion Prep Services, I’ve always tried to go above and beyond for my clients.

There have been times when I’ve prepared additional documents, spent extra hours reviewing information, and even covered certain expenses out of my own pocket because I genuinely wanted to help.

A conversation this morning reminded me that I need to create clearer boundaries around what is included in each service. When extra work is continuously added without an additional fee, it can become difficult to separate what was purchased from what was simply done as a courtesy.

So, effective today, September 4, 2026, client service agreements are officially going into effect.

Every client will have a written agreement clearly outlining what they purchased, what is included, and what records or documents the service is based on.

If additional work is needed outside of that agreement, we can absolutely discuss it. It will simply be treated as an additional service with its own agreement and fee.

I still believe in going the extra mile when I can. I just have to make sure that generosity doesn't create confusion about the services someone actually paid for.

Clear expectations protect both my clients and my business.
