⚑ Sales Tax News: Georgia Spent Years Trying to Tax Uber Like a Taxicab. They Just Gave Up.

The Georgia Department of Revenue assessed $22 million in sales tax on pre-Wayfair Uber rides, arguing that because Uber screens drivers and collects payment, it's functionally operating as a car-for-hire service under the state's taxicab regulation.

Uber pushed back and won. Not on the marketplace facilitator argument. Not on the Internet Tax Freedom Act. The winning argument was one level up: nothing in the actual statute makes Uber a taxicab. The Department was stretching a regulation to cover something the legislature never authorized.

The Georgia Supreme Court agreed. The Department withdrew rather than defend it.

πŸ’‘ The takeaway: Before you fight the transaction-level argument, check whether the regulation is even authorized by the statute. Pull the reg. Read the enabling statute. Most people skip this step β€” but it's often the strongest challenge available in sales tax disputes.

⚑ Sales Tax News: The wealth tax wave is here and it's spreading fast. What started in California and Washington has now reached Colorado, Rhode Island, and New York. States need revenue, and high earners are the target.

Washington's 9.9% tax is already live, and luxury home listings have jumped an estimated 65% as wealthy residents look for the exits.

Colorado voters decide last November on a graduated income tax for high earners, with rates potentially reaching 8.4% for top earners and business owners.

Rhode Island's so-called "Taylor Swift Tax"β€” a surcharge on vacant homes over $1 million continues to make headlines.

California's billionaire tax targets the state's roughly 200 wealthiest residents, despite facing real constitutional hurdles. Meanwhile, New York is still working to administer its pied-Γ -terre tax.

These new tax concepts are already drawing legal challenges on both substance and procedure. Expect more fights ahead.

Proactive residency planning is no longer optional. If you wait for an assessment, you've waited too long.

At Sales Tax Helper, we navigate these shifts and challenge the agency on your behalf. Let's review your strategy today.

When businesses think about sales tax, they often focus on the state rate. But that's only part of the picture.

Many states allow counties and other local jurisdictions to impose their own sales tax rates. That means the correct rate may vary depending on where your customer receives the product or service, not just where your business is located.

Using the wrong rate can result in under-collecting sales tax, overcharging customers, or creating compliance issues that may lead to penalties.

Staying compliant means understanding both state and local tax requirements. Sales Tax Helper can help you navigate the complexities of sales tax with confidence.

If your business has unfiled or unpaid sales tax obligations in Indiana or Illinois, now may be the best time to take action.

Both states are offering sales tax amnesty programs, giving eligible businesses the opportunity to come forward and resolve outstanding liabilities with significant relief from penalties and interest.

Current deadlines:
πŸ“ Indiana: Amnesty ends September 9
πŸ“ Illinois: Amnesty runs August 1 through October 31

These programs won't be available forever, and waiting until you're contacted by the state could mean losing valuable benefits.

At Sales Tax Helper, our team includes former state sales tax auditors who understand these programs from both sides. We help businesses evaluate their eligibility and navigate the amnesty process with confidence.

Many nonprofit organizations assume that because they qualify for a sales tax exemption on purchases, they don't have to collect sales tax on the items they sell. Unfortunately, that's one of the most common compliance mistakes nonprofits make.

In many states, a nonprofit's exemption applies only to what the organization buys, not necessarily what it sells. Sales of merchandise, event tickets, food, or other taxable items may still require collecting and remitting sales tax, depending on state laws and the nature of the sale.

Because sales tax rules for nonprofits vary by state, it's important to understand your organization's specific obligations before assuming you're exempt.

If you're unsure whether your nonprofit needs to collect sales tax, Sales Tax Helper can help you navigate the rules with confidence.

βš–οΈ $500M question: Is Maryland's digital ad tax dead? Watch the full video to get Sales Tax Helper's take on the recent news.

The Maryland Tax Court just torched the state's digital ad tax, ruling in favor of Apple, Peacock, and Google. The violation? The Internet Tax Freedom Act.

The court's logic was simple and brutal: digital ads and traditional ads are basically the same thing now. You can't tax one and not the other just because it's "digital." That's exactly the kind of discrimination ITFA was built to stop.

Refunds on the table: ~$500 million.

If you're doing SALT work in Illinois, Utah, or Washington– states running similar digital ad tax schemes- this ruling just became required reading. The precedent doesn't stay in Maryland.

As demand for AI and cloud computing grows, several states are reconsidering the tax exemptions offered to data centers. Supporters argue these incentives attract investment and jobs, while critics point to the strain on electricity, water resources, and lost tax revenue. Some states have already paused or proposed changes to these exemptions as they evaluate their long-term impact.

What do you think is the right approach?
πŸ’¬ Should states:
β€’ Continue offering tax exemptions?
β€’ Tie incentives to stricter accountability and infrastructure investment?
β€’ Eliminate the exemptions altogether?

We'd love to hear your perspective.

With Nexus ruling ever-changing, it is important to avoid practices that put your business at risk for an audit.

: Review where you currently have nexus and identify applicable rule changes, register your business in states where it's required, and determine if your business has unknowingly created Nexus by engaging in contract labor, attending out of region trade shows, or otherwise doing business temporarily in other states.
