Rob Berman and Barry Greenberg recently participated in a site visit at our client's project, Metrowest, as part of Urban Land Institute's (ULI) Partnership Forum Program.

Jamar Brown and Flannery Gallagher recently secured a significant victory before the Supreme Court of Maryland, achieving a result with meaningful implications for foreclosure proceedings across the state.

Arguing on behalf of a trustee in a foreclosure action, Jamar convinced the Supreme Court to overturn a prior Appellate Court of Maryland decision invalidating a foreclosure sale and permitting the borrower to litigate post-sale defenses sounding in fraud.

Resolving a question “left open” in its prior decisions, the Supreme Court held that a borrower may not raise as a post-sale exception any defense that it included or should have included in a motion to stay the sale and dismiss the foreclosure action.

This decision clarifies and provides important guidance on foreclosure procedures in Maryland and promotes certainty in the process for potential third-party purchasers.
