FEWA COO Arnulfo Hinojosa was a panelist during the Human Resources Conference for the National Council of Farmer Cooperatives held in Salt Lake City, Utah. The panel discussion "Immigration Enforcement: Impacts on Your Workforce," included Hinojosa plus Sarah Becker, GROWMARK; John Cain, Tennessee Farmers Cooperative; and Anne Warren, Mid Kansas Cooperative. Arnulfo found time to visit the state capitol and catch an awesome sunset at the conference hotel.

The Employment and Training Administration published a Federal Register notice (announcing the Adverse Effect Wage Rates (AEWRs) for the employment of all non-range H-2A job opportunities. Find the new rates by state here.

AEWRs are the minimum wage rates the Department of Labor has determined must be offered, advertised in recruitment, and paid by employers to H-2A workers and workers in corresponding employment for a particular occupation and area so that the wages and working conditions of workers in the United States similarly employed will not be adversely affected. For many H-2 workers, receiving a visa interview approval is the final step before traveling to the United States. However, some workers may be informed by a U.S. Consular Officer that their application has been placed in Administrative Processing. The House Homeland Security Appropriations Subcommittee has released its 2027 Department of Homeland Security funding bill, and it contains an important victory for seasonal employers that rely on the H-2B program.

Included in the legislation is Certified Seasonal Employer (CSE) language that the H-2B Workforce Coalition has been advocating for over the past several years. The provision would provide cap relief for employers with a demonstrated history of participation in the H-2B program.

Specifically, employers that received labor certifications during 2022 - 2026 would be eligible to receive H-2B positions 2027 that are exempt from the annual visa cap, up to the highest number of positions for which they were certified during any one of those previous five fiscal years.
