Who needs a will?

1. Anyone who doesn’t want the Nebraska State Legislature deciding what happens to your assets when you pass.

When someone passes without a will, their estate, meaning assets, is considered “intestate”. This means that Nebraska State Statutes determines who gets their assets. For someone without a spouse or kids this can mean their parents. For someone without close relatives, this could mean a long lost relative they have never met.

2. For parents of minor children, a will also allows for nomination of guardians of the children if something were to happen to both parents. So, the parent, not the court, is saying who they want to take care of their children.

By setting up a will, you dictate who gets your assets, who takes care of your children, making your wishes clear to not only your loved ones, but the state.

Last year, a family member decided they wanted to sell their business and retire.

So, he put the restaurant up for sale, and found a buyer.

Unfortunately, when it came time to do the legal paperwork, it was revealed that the estate of his late wife and business partner had never been settled.

Not only that, her will had never even been signed.

Obviously, the sale couldn’t take place under those circumstances, so retirement had to be placed on hold while the estate was settled.

Most people assume that once a will is in place, they’ve done what needs to be done. And legally, that may be true. But practically, there is often a significant gap.

A will doesn’t tell someone where everything is, who to call, what needs immediate attention, or how to access what’s already in place. Those details are what people end up scrambling to figure out—often under stress, time pressure, and uncertainty.

That’s why I’ve set up the Essential Information Framework. It’s a structured, facilitated process that leads to an Estate Information Portfolio.

It’s not a collection of data or documents. It’s a resource that allows a trusted party to step in and keep things running smoothly when it really matters.

This work is about getting those pieces organized ahead of time. It’s about having things clear, accessible, and actually usable when someone needs to take responsibility either due to temporary incapacity or death. It’s about being prepared so that an already stressful time is just a little easier.

I had to roll out of bed early to start on the day. So early that the street lights were still on when I headed out for my walk. There are no lights at the park. I was a little uncomfortable.
