Effective January 1, 2020, the new overtime rule will raise the salary cut-off to $35,568 annually ($684 weekly). To be exempt from overtime, your employees must be paid a salary or weekly wage of at least the threshold ($35,568 and $684 respectively) as well as meeting specific duties tests. If employees are paid less than the threshold or don’t meet the duties tests, they must be paid 1 ½ times their regular hourly rate for hours worked over 40 in a single workweek. This rule applies even if an employee is classified as a supervisor, manager, or professional.

If you offer nondiscretionary bonuses or incentive payments, that pay may be used to satisfy a portion of the wage level. If you have highly compensated employees on your staff, that threshold has been raised, and duties have been modified for highly compensated employees as well.

Employers – you should start reviewing job descriptions and budgets. Should you reclassify ALL employees who are going to be affected? Not necessarily. Contact us at The Employment Source if you’re having trouble coming up with creative solutions, or to discuss training and communication strategies – we know there will be questions!
