The paperwork arrived after sentencing.

Treatment started. Progress was real. The documentation came in two days late. The judge had already decided. Timing isn't administrative... it's the whole argument.

Most defendants think the judge is deciding how to punish them.

Wrong question.

The judge is trying to predict whether you'll be back. That's it. Every piece of treatment documentation answers that prediction. Every session attended, every counselor note, every drug test passed - it all says "the pattern is changing." And that's what actually shifts the outcome.

Here's the thing courts don't see rehabilitation happening in real time, they see what's documented when they're making the decision. Progress without evidence is completely invisible to the system. A judge reviewing your case at 4pm on Thursday needs proof that you're different now than you were at arrest, not promises about what you'll do later.

And if that proof arrives Friday morning?

Too late.

The decision gets made with incomplete information. And incomplete information defaults to risk assessment based on the charge alone. The judge predicts recidivism because there's no documented evidence suggesting otherwise.
