SECURE vs. SUSTAIN: What Should Covered Entities Know?

Both 340B reform proposals would strengthen protections around contract pharmacies and manufacturer restrictions, but also bring more reporting, data requirements, and oversight.

Right now, SUSTAIN appears more favorable to covered entities, especially in preserving the traditional upfront 340B discount and limiting rebate models.

Big changes may be coming to 340B in 2027.

HRSA’s revised 340B Rebate Model Pilot could require covered entities to purchase certain drugs at WAC and receive the 340B discount later through a rebate.

What should covered entities be watching?
• Cash-flow impact
• Claims-data requirements
• Vendor and TPA readiness
• Rebate tracking and reconciliation
• Patient-access workflows

And importantly: CAHs, FQHCs, and rural hospitals are not automatically exempt.

Now is the time to start evaluating potential exposure and operational readiness.

340B manufacturer claims data requirements are expanding in 2026!

As of June, ten manufacturers have implemented or announced claims-level data submission requirements, creating new operational and compliance challenges for covered entities.

Covered entities should track effective dates, impacted products, required data fields, submission deadlines, state exemptions, vendor responsibilities, and internal data-sharing decisions.

Because each policy is manufacturer-specific, requirements should be reviewed individually before data is shared.
