As of this month, homeowners may record ANY inspections by their insurance company within their homes (with two conditions). This is a big decision that makes it easier for homeowners to protect themselves from insurer fraud.
In Gesten v. ASI Corp., the Fourth District Court of Appeals stated that when your insurance policy is silent on this issue, the insurer does not have a legitimate expectation of privacy. As long as your policy doesn't prohibit recording inspections and you inform your insurance company before recording, you can audio/video record any and all inspections by your carrier within your home and the insurer cannot refuse.
