NEW LAW TAKING EFFECT SEPTEMBER OF 2025:

Beginning September 26, 2025, Oregon employers of all sizes won’t be able to ask or require applicants to provide their age, date of birth, or school attendance or graduation dates prior to completing an initial job interview. If there’s no interview, the employer can’t ask prior to a conditional offer of employment.

However, employers can request this information to verify that the applicant meets a genuine bona fide occupational qualification or to comply with an applicable law. For example, an employer can ask for a birth date to verify that the applicant is old enough to sell or serve alcohol if that’s part of the job.

IRS MILEAGE REIMBURSEMENT RATE INCREASE Effective 1/1/2024

The standard mileage rate will be 67 cents per mile driven for business purposes (up from 65.5 cents in 2023). This rate also applies to electric and hybrid vehicles.

A Notice from the State of Oregon:

The Oregon Child Support Program relies on businesses to help ensure the financial security of children in several different ways. One of those is by businesses reporting newly hired employees to the Oregon Child Support Program at the Oregon Department of Justice. This information is maintained in the National Directory of New Hires and allows child support agencies across the nation to locate parents who owe child support.

A new Oregon requirement to report individuals who are independent contractors takes effect on January 1, 2024. This notification is for your awareness only at this time. We will send additional information about how you can begin complying with the new law in the spring of 2024.

The new reporting requirement is the result of Senate Bill 184 passed by the Oregon Legislature in May 2023. Senate Bill 184 expands the existing requirement in ORS 25.790 to report new employees to the Oregon Child Support Program to include individuals who are independent contractors as well.

Who is an independent contractor?
For this reporting requirement, an independent contractor is an individual who:

must submit a federal form W-9 under the Internal Revenue Code;
is anticipated to perform services for more than 20 days; and
is not considered an employee.

How will I know if I have to report an independent contractor?
If you expect to engage or reengage an individual who is an independent contractor for more than 20 days, you must report that individual to us.

When do I need to report an independent contractor?
We are doing a soft launch of this new reporting requirement. This means that, for now, you do not need to report an individual who is an independent contractor to the Oregon Child Support Program. We will follow up with more information in the spring of 2024.

Where should I report an independent contractor?
If you do choose to report an individual who is an independent contractor as early as January 1, 2024, you may do so by completing the New Hire Reporting Form (01 0580) available on our website at OregonChildSupport.gov/employers. Submit the completed form by fax or mail to:

Help ensure your employees have health insurance!

It's open enrollment season for 2024 health insurance. If you do not offer your employees coverage, they may be able to enroll through the Oregon Health Insurance Marketplace and get financial help. If they have recently lost Oregon Health Plan benefits, they can enroll anytime until July 31, 2024, or within 60 days of their OHP benefits ending.

The Marketplace offers quality coverage from top insurers like Bridgespan, Kaiser Permanente, Moda Health, PacificSource Health Plans, Providence Health Plan, and Regence. All plans include:

A robust set of health benefits, even before deductibles are met
Preventive and wellness care services, as well as little-known services like visits to naturopaths, chiropractic and acupuncture
Check OregonHealthCare.gov to preview plans, see covered prescriptions, and verify if your preferred providers are included.

Employers from all states will be receiving their Employment Department tax rate notices in November or early December to update their tax rates in payroll effective January 1, 2024.

Also during this time employers also receive annual payroll tax payment notifications from the IRS. These letters provide you with your schedule for paying your payroll taxes for the new year. You will see the following statement on the letter; “What Are Your Federal Tax Deposit Requirements"? Following this will be your schedule for the new year. Most of the time this doesn’t change from the schedule you are currently on but this is how they will notify you if they do change your tax deposit schedule.
