⛔️ Think a voicemail drop is safe from TCPA fines just because it sounds like a real human? Think again. 🎙️

In the case Edward Newman Jr. v. Abstrakt Marketing Group, LLC, a federal lawsuit was allowed to proceed over a single 7-second voicemail drop. The message started with a flat "Hello," had no background noise, and cut off abruptly, all indicators of automation.

Here is the compliance trap: Even if a real human records the audio, dropping a prerecorded voice message into a consumer's inbox without explicit, written consent is a major TCPA violation. To make matters worse, the company’s own website copy promoting "voicemail drops" was weaponized against them in court.
