Most groups assume California kills deficiency recovery.

That’s not entirely true.

OLAF Advisory recently supported an appellate win tied to a non-judicial foreclosure and guarantor enforcement, providing oversight on behalf of the fund, including direct involvement from Paul as a witness in the matter.
At the trial level, the court wiped out the recovery under antideficiency arguments.

The appellate court reversed.

The takeaway:
Deficiency recovery is still viable in California — if the guaranty is structured correctly and the strategy is actually executed.

What we’re seeing across portfolios:
• Guarantor exposure exists but isn’t being pursued
• Documents weren’t built with enforcement in mind
• Post-sale recovery strategy is inconsistent or nonexistent

The result is simple:
Recoverable dollars are getting written off.

This isn’t just a legal issue.

It’s an ex*****on gap between origination, default, and recovery.

Revenue is not only won in the work.
It is won in how the work is billed, defended, and resolved.

Billing compliance matters.
Servicer nuances matter.
And disciplined negotiation matters.

A good bill is not just an invoice.

Too many firms lose recoverable revenue because the bill is not built with precision, servicer-specific requirements are missed, or fee requests are pushed onto attorneys and paralegals who should be focused on legal ex*****on, not operational resolution. This wasn’t a retreat, a perk, or a one-size-fits-all holiday party. It was a live demonstration of how OLAF approaches leadership differently—intentionally, relationally, and with standards that hold even when no one’s watching.
