Clearly this bill was more about protecting rural auctioneers than anything else. Looks a little like a "good ol' boy" network going on or it is it just me. The Illinois law promoted as protecting rural auctioneers is now being used to regulate estate sale companies, even though estate sales are not auctions. Estate sale professionals typically conduct fixed-price or negotiated sales, not competitive bidding. By placing estate sales under the Auction License Act, the law applies requirements designed for auctioneers to an entirely different industry.
This approach does not meaningfully improve consumer protection. Instead, it creates unnecessary barriers for small estate sale businesses, raises costs for families needing liquidation services, and limits consumer choice. If the intent is public protection, estate sales should be regulated under a distinct, appropriately tailored category, not forced into an auctioneer framework that does not reflect how the industry actually operates.
The law will require a licensed auctioneer to be involved in any online auctions, estate sales, and estate services in Illinois.
