Clearly this bill was more about protecting rural auctioneers than anything else. Looks a little like a "good ol' boy" network going on or it is it just me. The Illinois law promoted as protecting rural auctioneers is now being used to regulate estate sale companies, even though estate sales are not auctions. Estate sale professionals typically conduct fixed-price or negotiated sales, not competitive bidding. By placing estate sales under the Auction License Act, the law applies requirements designed for auctioneers to an entirely different industry.

This approach does not meaningfully improve consumer protection. Instead, it creates unnecessary barriers for small estate sale businesses, raises costs for families needing liquidation services, and limits consumer choice. If the intent is public protection, estate sales should be regulated under a distinct, appropriately tailored category, not forced into an auctioneer framework that does not reflect how the industry actually operates.

The law will require a licensed auctioneer to be involved in any online auctions, estate sales, and estate services in Illinois.

ok followers. have you heard of the new Illinois Law that went into effect January 1? It requires all estate sale companies to become auctioneers. Well that is it in a nutshell. Small work around is NO NEGOTIATIONS. They are pushing estate sale companies into a box we do not belong. We are suggesting our own category similar to Real Estate Professionals. It would require us to be bonded, licensed and insured. (seems reasonable...get a few of the riff raff companies out )
This new law would push out many small companies that don't want to pay for classes, take the tests, pay the fees and follow the rules of auction houses (also they would require for us to ask WHO purchased each item! ) It will be fine that will comply (even though it makes no sense unless they are going into the online auction business) Some of the ones that have complied have started telling potential customers not to hire the other companies. What do you think about this new Don't let your old reliable estate sale companies go away! Consider reading the petition I have put together.
