To be FCRA compliant, an employer must...
✔ Disclose to the candidate that you intend to run a background check on them, and the purpose for it
✔ Obtain signed authorization from the candidate which permits the employer to run the background check
In addition, an employer should also provide the candidate with a 'Summary of Your Rights Under the Fair Credit Reporting Act' document as prescribed by the Consumer Financial Protection Bureau (CFPB). Certain states also require specific disclosures and procedures as well.
