3 Essential ADA Scoping Issues:[Do not overlook]

We highlight overlooked ADA scoping provisions, especially in new constructions and alterations. Key points include understanding scoping requirements, noting exceptions, and following best practices. Compliance is essential to avoid litigation and enhance business accessibility.
1. Architectural and Engineering Oversights: Many design professionals concentrate on the technical dimensions outlined in Chapters 4-10, neglecting the scoping provisions in Chapter 2. This oversight can lead to incomplete compliance and increased litigation risks for professionals and their clients.
2. Exceptions: Section 203 of Chapter 2 specifies exceptions for 13 types of spaces, such as employee work areas. These areas are often misunderstood, with the only requirement being the ability to "Approach, Enter, and Exit." Additionally, accessible egress routes are mandated by the International Building Code.
3. When elements are intended for public or employee common use (not used specifically for working purposes) and do not have specific scoping requirements, all of these elements would be required to be accessible. Typical requirements for such elements include providing an accessible route to the element, a Clear Floor Space (30x48 min.) at the element, and the highest operable part must be located at a reach range between 15" – 48" above the finished floor. These requirements can be found in Chapter 3: Building Blocks (2010 ADA Standards, Chapter 3: Building Blocks) of the 2010 ADA Standards.
For businesses, understanding and adhering to these provisions is a legal obligation and an opportunity to enhance accessibility and attract a broader customer base. Correcting overlooked or misinterpreted provisions can be costly and time-consuming, making it crucial to familiarize yourself with the ADA standards before construction or alterations.
