Prepare for Customs Delays if the US Government Shuts Down

Dear Valued Customer,

With the looming threat of a US government shutdown at 12:01 AM on Sunday, October 1, prepare for delays on import shipments clearances.

U.S. Customs and the Food and Drug Administration have confirmed they will be considered essential staff and plan to operate at current levels. However, many other government agencies (PGA’s) that also participate in the clearance process will have varying levels of staffing dependent upon their designation in the “critical” staffing hierarchy.

Prepare for delays on shipments needing a PGA for examination, sampling, or testing. Working closely with your trusted brokerage advisor when deciding to submit clearance or hold submission pending renewal of government services will help you find your optimal solution.

Labor Action Shuts Down West Coast Ports

Dear Valued Customer,

Members of the ILWU have staged a “no show” that has effectively shut down many West Coast ports, including Los Angeles and Long Beach, Oakland, Tacoma, Seattle, and Hueneme. At this moment, no one knows when normal operations will resume.

Multiple media reports are also warning that more port shutdowns are expected to spread along the West Cost, as workers are refusing to report for assignments due to the unending ILWU-PMA contract negotiations, which have been on-going since last May.

Due to the potentially chaotic situation, we are imploring all our clients to, whenever possible, route their goods through East and Gulf Coast ports until this situation is completely resolved.

As the ILWU-PMA contract negotiation standstill swiftly approaches a full year, strikes and slowdowns remain a worrying possibility especially after the recent trends of worker slowdowns. Any activity still has the possibility to result in massive backlogs, disruptions, and rate increases – which has the potential to cause significant harm to small and medium size importers.

COVID-19 Outbreaks in Qingdao City, Shandong Province, and Henan Province

Dear Valued Customer,

COVID-19 outbreaks in Qingdao City, Shandong Province, and Henan Province have resulted in corresponding shutdowns. These recent shutdowns have resulted in the following:

- Factories in the regions are locked down and inactive
- Outbound freight from those factories is halted
- Bookings meant for those outbound goods have been cancelled

While we do not anticipate a significant effect from this specific situation, shippers need to remember that China’s Zero COVID policy is still active and sudden disruptions will continue to unexpectedly occur as long as that policy remains in place.

Therefore, it is possible that these current shutdowns or later shutdowns could result in longer than average ocean freight delays, which could compound the current situation on U.S. railways. Additionally, since a labor agreement has not been reached, it is also possible that the ILWU leverages these shutdowns or future shutdowns, which could result in severe backlogs and/or a shortage of carrier space and equipment.

As a result, we are advising all clients to be prepared. Therefore, in order to ensure the fluidity of your supply chain, we strongly urge you to reach out to your dedicated logistics advisor to review and, if necessary, adjust your supply chain to address both short-and-long-term needs.

Accident at the Port of New York-New Jersey

Dear Valued Customer,

An early morning incident forced the Port Newark Container Terminal (PNCT) to close at 8:30 a.m. (ET). Normal operations will resume tomorrow morning (July 14, 2022) at 6:00 a.m. (ET).

Also, PNCT has announced that it will be waving demurrage for today.

Earlier this morning, we received reports of a fire at Logistics Park Chicago (LPC). Please expect delays as truckers are temporarily being turned away.

We are working closely with truckers, carriers, and railroad operators to find alternate solutions. We are making every effort to avoid any additional and unforeseen costs that could arise from this incident.

Due to the high infection rate and recent increase in new COVID-19 cases, Shanghai has been declared a high-risk area. Government officials are now requiring truck drivers to be tested for infection upon entering and exiting the city, which is causing significant delays.

Additionally, lockdowns in three cities within the Hebei Province have made on-road transportation between high-traffic areas exceedingly difficult. As a result of new government restrictions and the approach of the Lunar New Year holiday, many truckers are avoiding travel at all costs and returning to their hometowns – decreasing the number of drivers available to transport goods.

Furthermore, the suspension of barge operators, who assist in transitioning cargo from land to sea, is continuing. These developments combined with current historical volumes are expected to add to overall congestion.
