The firm’s latest Miami Herald “Real Estate Counselor” column, authored by Michael L. Hyman, focuses on a recent appellate ruling that illustrates how the liability risks for associations can potentially go beyond property damage.

The decision by the Third District Court of Appeal arose from a case that originated in Miami-Dade Circuit Court involving a condominium located in the Fontainebleau neighborhood near Doral.

According to Michael, this ruling illustrates how associations that are negligent in maintaining shared plumbing elements or ignore documented reports of corroded pipes can potentially be held liable for resulting property damage and injuries.

South Florida Reps. Debbie Wasserman Schultz and Maria Elvira Salazar reintroduced the "Making Condos Safer and Affordable Act" in the U.S. Congress. The new Act is designed to expand access to federal financing tools to help condominiums.

The goal: help communities address structural needs before they become costly emergencies, and make it more affordable to do so.
