Most birth injury malpractice cases don’t start with the emergency C-section.

They start hours earlier in the fetal monitoring strip.

As a high-risk labor & delivery RN reviewing obstetric records, the first things I look for are:

• recurrent late decelerations
• minimal variability
• tachysystole with Pitocin
• delayed escalation
• prolonged decision-to-delivery times

These patterns can quickly reveal whether the standard of care may have been met.

A fetal heart tracing shows recurrent late decelerations.

The nurse documents the pattern.

But escalation to the physician doesn’t happen for another 20 minutes.

During that time:

• variability disappears
• the tracing deteriorates
• a prolonged deceleration occurs

An emergency C-section follows.

But by then, the injury has already occurred.

Not all abnormal fetal heart tracings lead to litigation, but these three almost always do.

1. Persistent late decelerations
A sign of utero-placental insufficiency. When they continue without intervention, the risk of hypoxia rises quickly.

2. Prolonged bradycardia
A sustained drop in the fetal heart rate often signals an acute event. Time to intervention becomes critical.

3. Category III fetal heart tones
Absent variability with recurrent decelerations or bradycardia. This is an obstetric emergency, not a “wait and see” situation.

In many birth injury cases, the issue isn’t the tracing itself, it’s the delay in response.
